The <br />Applicant's accounting includes the 2% relinquishment requirement for the nontributary <br />Laramie-Fox Hills water. <br />In addition to replacing depletions resulting from this mining operation, the Laramie-Fox <br />Hills aquifer water will also be used by the Applicant to replace 16.08 acre-feet of depletions <br />resulting from operations at the Parker-Dersham site in accordance with the C.R.S. 37-92- <br />308(11) SWSP approved for Hall-Irwin. Since the Laramie-Fox Hills water is being used as a <br />replacement source for both plans, the applicant's accounting for each SWSP must specify the <br />total amount of Laramie-Fox Hills water released and the amount associated with each SWSP. <br />A monthly breakdown of depletions and replacements is shown in attached Table 3. <br />Conditions of Approval <br />approve the proposed substitute water supply plan in accordance with Section 37-90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of January 1, 2008 through December 31, 2008, <br />unless otherwise revoked, modified, or superceded by decree. If this plan will not be <br />made absolute by a water court action by the plan's expiration date, a renewal request <br />must be submitted to this. office with the statutory fee (currently $257) by November 1, <br />2008. <br />2. The losses associated with this mining operation must not exceed a total of 48.74 acre- <br />feet for the duration of this permit approval. These losses include 22.38 acre-feet of <br />evaporation from the proposed exposure of 7.6 acres of groundwater after December <br />31, 1980, 12.43 acre-feet of water lost in product (4% moisture of 422,500 tons of raw <br />material), 1.66 acre-feet for on-site dust control, 12.28 acre-feet used in the production <br />of 100,000 tons of concrete. Should the consumptive use at the site exceed 48.74 acre- <br />prior to the expiration date of this plan, an amendment will need to be filed with this <br />office. <br />3. Approval of this plan is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by this office.
