Rationale for Recommendation for Approval <br />Over Objections; Regular 112 Construction Materials Permit Application, <br />Lyster Oil Company, Inc. <br />Lyster Pit, File No. M-2008-009 <br />July 23, 2008 <br />Introduction <br />On July 23, 2008 the Division of Reclamation, Mining, and Safety ("Division") issued its recommendation <br />for approval of a 112 Construction Materials Permit Application, over objections. This document is <br />intended to provide a basis for the Division's recommended approval over various concerns and reasons for <br />objection to the Lyster Pit permit application, File M-2008-009. <br />The Lyster Oil Company, Inc. permit application was found complete and considered filed. with the <br />Division on March 12, 2008. The site is located approximately 2 miles south of the city of Craig, Moffat <br />County, Colorado. The property is located in Section 8, Township 6 North, Range 90 West of the Sixth <br />Principal Meridian. The proposed permit application consists of 60 acres. The proposed post-mined land <br />use for the site is Developed Water Resource. Reclamation at the site includes some grading of the <br />disturbed acreage, plus topsoil replacement and seeding and fertilization in areas designated as pastureland <br />to re-establish vegetation. <br />1. ISSUES RAISED BY OBJECTING PARTIES DURING THE COMMENT PERIOD: <br />A. ISSUES WITHIN THE JURISDICTION OF THE DIVISION AND BOARD <br />Issues raised by the objecting party are listed below. The Division's response to objection issues follows: <br />1. Rule 3.1.7 - Groundwater - Specific Requirements <br />• The original comment letter states that there are concerns related to whether the operation will <br />affect the water quality and quantity of the unclassified groundwater near the site and the <br />potential to impact surrounding domestic water wells.
