Box 1821 <br /> Colorado Springs, CO 80901 <br /> RE: GEC West Pit Reclamation <br /> Dear Dr. Corley: <br /> Enclosed is a signed copy of the "Addendum to Agreement Concerning <br /> Diversion of Water into Magpie Creek" which you recently signed <br /> and returned to the Division. The drainage work outlined in the <br /> agreement is expected to be initiated as soon as Kessler <br /> Reclamation is available to do the work. <br /> Prior to signing the agreement, you made one edit to item 7d. As <br /> edited, the agreement indicates the scope of work to be funded with <br /> the last $800 of Harrison Western money will be determined by The <br /> Corley. Company. As we discussed, the Division anticipates doing <br /> this work in conjunction with final work related to the East Pit <br /> project, while a contractor and equipment are on site. The <br /> Division will notify you when the outstanding issues with the East <br /> Pit contractor are resolved and completion of the project is <br /> scheduled. At that time, the Division will consider options for <br /> completing Section 24 work which you might identify. Obviously the <br /> final determination of the scope of work must be made by the <br /> Division in its contract with the party doing the reclamation. <br /> If resolution of the outstanding issues at the East Pit entails <br /> unreasonable delays or results in no further work on that project, <br /> the Division will seek a contract to complete whatever maintenance <br /> work The Corley Company has identified which can be funded with the <br /> remaining $800. <br />
