History of Division Activities on the Corley Property <br /> GEC-Orphan Pit-1992 Prebid Meeting -� <br /> 5-8-00 Telephone conversation with in , om indicated that Dr. Corley attended this meeting <br /> and demanded that the nature and extent of the work be substantially modified from the scope of <br /> work set forth in the bid documents. Tom indicated that Dr.Corley was very argumentative and <br /> disagreeable. Tom felt there was no alternative but to reschedule the prebid meeting until such <br /> time that the Division and Dr.Corley could come to some agreement on the scope of work. <br /> GEC-Orphan Pit\RN-Coal Mines-8(Project Manager's Field Note Boo - rica Crosb he principal objectives <br /> of this project was to perform maintenance on drainage and impoundment structures,to construct a permanent <br /> diversion,to reclaim two small pits and one associated highwalls with the backfilling of miscellaneous coal waste, <br /> trash and fill,and to revetetate all areas disturbed in the project. <br /> 9-10-93 Dr.Corley was sent a copy of the design and is uncomfortable with what he feels is a rushed design. The <br /> Division felt that the design was adequate,it was conducted to get a new design per Dr.Corley's <br /> recommendations. <br /> 9-30-93 During a telephone conversation regarding access road construction,coal waste removal and the tipple <br /> area,Dr.Corley stated that the Division never follows it's own rules. He also expressed serious concern <br /> regarding the contractor's equipment having the proper safety equipment and that he be listed as an <br /> additional insured. (The contractor installed the safety equipment and the AG informed the staff that Dr. <br /> Corley did not have to be an additional insured) <br /> 10-14-93 During a meeting with Dr.Corley,Mr.Corley stated that he was still concerned with the west pit pond <br /> design and wanted to know it the Division would pay for maintenance of the site. He stated that he would <br /> not let us do the job until we committed to the liability and have convinced him of the design. Erica stated <br /> that this would delay the project and possibly not get it done this year. Dr.Corley stated that he has rights <br /> and will keep us off of the property. Also,Dr.Corley stated that he believed that the Contractor,Phil <br /> Kessler,damaged a pipeline along the north side of the access road. It was noted that the contractor had <br /> not yet commenced working in this area. <br /> 10-27-93 Dr.Corley is upset about a memo sent out by the Coal Program supervisor regarding the gate lock and the <br /> Diversion design. Dr.Corley again states that he will not allow the project to proceed until he is satisfied <br /> with the Division design. <br /> 10-28-93 Reference is made to an argument betty n Cathy Be ' d Dr.Corley at last years pre-bid meeting. <br /> 12-28-93 Dr. Corley arrived on site and asked quest ons a out the East Pit Access Road. Mr.Corley stated that he <br /> did not feel very involved in reviewing the designs and stated that he did not feel that the road issue had <br /> been addressed at that he would not allow the bid meeting to commence without these issues resolved. <br /> GEC Project-East Pit Coal Reclamation Project- The project work will involve reclamation of a large coal strip <br /> mine. The work included backfilling,grading,drainage ditch cons tion,permanent channel reconstruction and <br /> revegetation. . c. 9,P <br /> 10-21-93MLRB adopted a Board Order,as a result of a petition from Dr.Corley, setting a timetable for <br /> development and completion of reclamation at the GEC Coal Mine. All Reclamation work was to be <br /> completed by May 31, 1994. <br /> GEC West Pit <br /> 8-5-94 Stephen Brown,Assistant Attorney General,sent a letter to Dr.Corley informing Dr.Corley that the <br /> Division did not intend to delay the project work any longer to satisfy his concerns. The Division will <br /> instruct the contractor to proceed with construction in the West Pit. <br />
