Oak Street, Suite 200 <br />Fort Collins, CO 80524-2880 <br />RE: Letter of Response to an Objection and Protest from Non-Party <br />SerFer Pit 112 Reclamation Permit Application M2008006 <br />Larimer County, Colorado <br />N-?, ECF9 QED <br />UUL 10 2008 <br />Division of Reclamation, <br />Mining and Safety <br />The following discussion and attachments are submitted on behalf of our client, Connell <br />Resources, Inc., in response to your letter dated May 1, 2008 in reference to "SerFer Pit 112 <br />Reclamation Permit Application M2008006." The information and discussion below address <br />each comment within the formal objection to the caption permit application as it was presented: <br />1. The addition of dangerous large truck traffic on County Road 13 to an area already <br />experiencing considerable truck traffic congestion, which will increase the danger to <br />school buses that use County Road 13 to transport children to and from school twice <br />daily during the SerFer Pit's proposed hours of operation. The current traffic <br />improvements and restrictions in the area are insufficient to properly_ and adequately <br />mitigate the increased traffic congestion. <br />A traffic study was performed for the proposed mining operation by Delich <br />Associates. According to. the study, only approximately 10% of the SerFer Pit <br />operation truck traffic will utilize CR 13 south of the site. The study showed the <br />level of service of CR 13, Highway 392, and the intersection of the two roads was <br />not changed. Furthermore, an acceleration/deceleration lane will be constructed. <br />on CR 13 prior to the start of SerFer Pit operations. <br />The performed traffic. study shows that the small increase in traffic should not <br />change the intersection's level of service. <br />2. The health hazards and dangers to users of the new Poudre Trail System immediately <br />adjacent to the proposed SerFer Pit. <br />It is unclear how the operation will adversely impact the Poudre Trail System. <br />However, Connell Resources,. Inc. will adhere to the Colorado Department of <br />Public Health and Environment (CDPH&E) permitting requirements as well as all <br />rules and regulations set forth by the DRMS-and the.
