Stutzmann <br />RE: SerFer Pit Annexation and Master Plan <br />July 3, 2008 <br />Page 2 of 3 <br />As shown in the mining plan of the DRMS permit application, setbacks from the <br />Poudre River have been established to further reduce any adverse affects to the <br />adjacent wildlife and human communities. <br />4. "These children will also have their lives negatively impacted by this proposed <br />project...they [Connell Resources, Inc.] would be glad to place an eight foot chain-link <br />fence with concertina wire around the project ...this would have the net effect of making <br />our beautiful nature preserve look like a high security prison." <br />In regard to site security and the safety of children, every precaution will be taken <br />to discourage children from trespassing on site, including corralling operations to <br />discourage unapproved access to the mine as shown in the DRMS permit <br />application. In the absence of enforceable guidelines for aesthetics, Connell <br />Resources, Inc. intends to complete mining operations in an efficient and <br />environmentally responsible manner. <br />5. "Heavy use of Mag-chloride may indeed affect the health of the residents." <br />Magnesium chloride is commonly used to help with dust suppression. Applying <br />magnesium chloride for dust suppression excludes the magnesium chloride from <br />being defined as a solid waste under the Resource Conservation and Recovery Act <br />(RCRA). Therefore, magnesium chloride cannot be classified as a hazardous <br />waste under RCRA because it is not a solid waste. <br />6. "How can you remove material down to 12+ feet and then backfill to the original grade <br />with what is left over? ...they will be trucking in foreign material." <br />--It--is-the intenfiori of the reclamation proposal-to convert-the missing volume of--------- <br />material into a water storage facility, which can be contracted or sold to outside <br />interests upon completion of this project. A large portion of the property will <br />consist of a reservoir while the remainder of the property will mimic the current <br />conditions of the environment. <br />It should be made clear that this project will proceed with the understanding that <br />only materials currently on site will be used in reclamation. No borrow-fill <br />should be necessary to produce the reservoir, its lining, or the appropriate cover of <br />topsoil necessary to replicate the current habitat. The reclamation plan outlines <br />the material type and depth required for reclamation. <br />7. "...we were told that this project would last 48 months, plus 3 months to finish <br />reclamation. There is no guarantee that this will indeed be the time frame." <br />The anticipated project length is currently expected to last approximately 4 years; <br />this includes completion of active mining operations and reclamation procedures. <br />If the DRMS 112 application is approved by the board, no specific time limit may <br />be imposed on the owner of the site.
