River West Homeowners Association
RE: SerFer Pit Letter of Response
July 3, 2008
9. The proposed SerFer Pit will have a significant adverse environmental impact on the air
and water in the area.
Connell Resources, Inc. will adhere to all rules and regulations required of the
proposed mining operation including the control of air and water pollutants.
A Spill Prevention, Control, and Countermeasure (SPCC) Plan has been
submitted with the DRMS application outlining the procedure Connell Resources,
Inc. will follow in the unlikely case of a spill. The purpose of the spill plan will
be to define the procedures that will be in place to prevent contamination of a
water table and other surrounding environments. The spill plan may be viewed in
the DRMS permit application
10. Heavy equipment and trucks accessing and leaving the proposed SerFer Pit will cause
additional road damage to already heavily used highways and roads.
It is unclear what is meant by the phrase "additional road damage." A traffic
study was performed for the proposed mining operation by Delich Associates.
Since there will not be a significant increase in Connell Resources, Inc. truck
traffic, the road destruction should be no more than current traffic provides.
Connell Resources, Inc.'s trucks and equipment will adhere to all standards for
using county and state highways, in addition to meeting all weight requirements
and limitations.
11. The utility of the HOA's Open Space will be adversely impacted by the proposed SerFer
Pit.
- - ----------------It-is-unclear-what--is-meant-by-the-"Utility-of-the HOA's-Open-Space"-and-how-it---------
will be adversely impacted by the proposed SerFer Pit. The mining will be
performed through "by-right" activities on privately owned property.
Furthermore, the property is designated on the town of Windsor Land
Management Map as open space, under which the allowable uses include mineral
extraction.
12. The proposed Hours of Operation of the proposed SerFer Pit are too long.
Due to the vagueness of "too long" the issue with the hours being too long can not
be addressed in depth. However, the proposed hours of operation are Monday
through Friday 7:00 am - 5:30 pm and Saturday 7:00 am - 3:00 pm. No work will
be performed on Sundays, holidays, or nights. These hours will provide for the
operations of the SerFer pit to be completed in a timely and efficient manner.
13. The storage of sand and gravel material mined from the site, as well as the storage of
materials on site but not mined on site, will further adversely impact the aesthetics of the
area.
