River West Homeowners Association <br />RE: SerFer Pit Letter of Response <br />July 3, 2008 <br />Page 4 of 6 <br />9. The proposed SerFer Pit will have a significant adverse environmental impact on the air <br />and water in the area. <br />Connell Resources, Inc. will adhere to all rules and regulations required of the <br />proposed mining operation including the control of air and water pollutants. <br />A Spill Prevention, Control, and Countermeasure (SPCC) Plan has been <br />submitted with the DRMS application outlining the procedure Connell Resources, <br />Inc. will follow in the unlikely case of a spill. The purpose of the spill plan will <br />be to define the procedures that will be in place to prevent contamination of a <br />water table and other surrounding environments. The spill plan may be viewed in <br />the DRMS permit application <br />10. Heavy equipment and trucks accessing and leaving the proposed SerFer Pit will cause <br />additional road damage to already heavily used highways and roads. <br />It is unclear what is meant by the phrase "additional road damage." A traffic <br />study was performed for the proposed mining operation by Delich Associates. <br />Since there will not be a significant increase in Connell Resources, Inc. truck <br />traffic, the road destruction should be no more than current traffic provides. <br />Connell Resources, Inc.'s trucks and equipment will adhere to all standards for <br />using county and state highways, in addition to meeting all weight requirements <br />and limitations. <br />11. The utility of the HOA's Open Space will be adversely impacted by the proposed SerFer <br />Pit. <br />- - ----------------It-is-unclear-what--is-meant-by-the-"Utility-of-the HOA's-Open-Space"-and-how-it--------- <br />will be adversely impacted by the proposed SerFer Pit. The mining will be <br />performed through "by-right" activities on privately owned property. <br />Furthermore, the property is designated on the town of Windsor Land <br />Management Map as open space, under which the allowable uses include mineral <br />extraction. <br />12. The proposed Hours of Operation of the proposed SerFer Pit are too long. <br />Due to the vagueness of "too long" the issue with the hours being too long can not <br />be addressed in depth. However, the proposed hours of operation are Monday <br />through Friday 7:00 am - 5:30 pm and Saturday 7:00 am - 3:00 pm. No work will <br />be performed on Sundays, holidays, or nights. These hours will provide for the <br />operations of the SerFer pit to be completed in a timely and efficient manner. <br />13. The storage of sand and gravel material mined from the site, as well as the storage of <br />materials on site but not mined on site, will further adversely impact the aesthetics of the <br />area.
