River West Homeowners Association <br />RE: SerFer Pit Letter of Response <br />July 3, 2008 <br />Page 3 of 6 <br />5. Dust and air pollution in the area will be greatly increased. <br />Connell Resources, Inc. will adhere to the Colorado Department of Public Health: <br />and Environment (CDPH&E) permitting requirements. This includes submitting <br />an Application for Construction Permit and Air Pollutant Emission Notices <br />(APEN). A Fugitive Dust Control Plan will be submitted as part of the <br />Construction Permit and Air Pollutant Emission Notices permit application. A <br />Particulate Emissions Control Plan is included in the Construction Permit and <br />describes how the dust and particulate matter will be controlled. <br />6. The visual impacts of adding yet another gravel pit to the area will unduly burden the <br />adjoining landowners in the area. <br />The gravel pit is in accordance with the Town of Windsor Land Management Plan <br />and is consistent with the surrounding land use. The proposed SerFer Pit is a <br />short-term mining operation lasting approximately four years. The final stage of <br />the project will be reclaiming the mine into a reservoir providing aesthetics to the <br />surrounding areas and water storage. Noise abatement measures will also limit <br />the visual impact of the mining operations. Furthermore, the mine is across the <br />Cache la Poudre and should not be directly visible to River West Development. <br />The view of the proposed mine site is mostly obstructed by trees growing along <br />the Cache la Poudre river. Other surrounding areas involve two other mines and a <br />state highway. <br />7. The proposed SerFer Pit will unreasonably impair the public health, welfare, prosperity, <br />and safety of the current and future residents of the area. <br />It is unclear how the operation will have a detrimental effect on the quality of life, <br />health, or cause a devaluation of personal property through "by-right" activities <br />on privately owned property in the area. <br />Connell Resources, Inc. will adhere to all rules and regulations required of the <br />proposed mining operation. These rules and regulations set forth by various <br />divisions are designed to prevent adverse effects on the health, welfare, prosperity <br />and safety of the current and future residents. of the area. <br />8. Existing wildlife in the area will be displaced by the development and operation of the <br />proposed SerFer Pit. <br />Although it is not expected that the existing wildlife currently located on the <br />projected site will relocate south of the Cache la Poudre River, the migration of <br />the wildlife to other areas cannot be restricted or controlled by Connell Resources, <br />Inc. It is unclear however, whether the wildlife of this area existed on the current <br />site before the development of surrounding areas, including the River West <br />development, or if the wildlife in this area were forced out of those areas as well.
