III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Carbon Junction Mine conducted by Tom Kaldenbach of DRMS. <br /> No one else was present. The entrance gate was locked. The site was dry. <br /> Phase I reclamation liability(backfilling,grading,and drainage re-establishment)remains for the following <br /> areas: topsoil stockpiles 4,7,and 8;the two sediment control ponds(1 and 2);various ditches;and various <br /> boreholes. Phase I reclamation liability also remains for removal of equipment from the Equipment Yard. <br /> Phase II and III reclamation liability(topsoiling and revegetation) remains on all disturbed areas. <br /> Selected photographs taken during the inspection are provided at the end of this report. <br /> Availability of Records <br /> All required records were on file at the office of Goff Engineering(see attached list). <br /> Signs and Markers <br /> Permit boundary markers were properly displayed at the numerous locations inspected. Topsoil markers <br /> were properly displayed on the only remaining stockpiles: 4, 7, and 8. The mine i.d. sign was properly <br /> displayed on the only public road entrance into the permit area. <br /> Roads <br /> The asphalt-surfaced main haul road was in good condition. The main haul road and the North Pit haul <br /> road have previously been approved for permanent retention,as documented in Appendix 5-1 of the permit <br /> application. The width of the North Pit haul road has been reduced to 30 feet as specified on page 5-26 of <br /> the approved reclamation plan. The road surface of the North Pit haul road was in good condition during <br /> the inspection. <br /> Hydrologic Balance <br /> Drainage routing. Pond 1 (the large pond) receives runoff from the coal permit area and gravel permit <br /> area. The following four parts of the coal permit area drain to Pond 1: the north half of the North Pit <br /> reclaimed slope,the east half of the PRSA,the South Pit Drill Pad,and the Equipment Yard. Runoff from <br /> the west half of the PRSA reports to Pond 2. Runoff from the south half of the North Pit passes through a <br /> grass filter terrace at the base of the reclaimed slope and then flows to the newly constructed Carbon <br /> Junction channel via the ditch next to the North Pit Haul Road. The south half of the North Pit reclaimed <br /> slope was approved as a small area exemption in TR-14. No water was flowing on the site during this <br /> inspection. Positive drainage appeared to exist throughout the drainage route from backfilled areas to the <br /> ponds. <br /> 3 <br />
