III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Tom Kaldenbach of DRMS. Henry Barbe of Mountain <br /> Coal Company represented the operator. Selected photographs taken during the inspection are <br /> attached to the end of this report. With the operator's consent,this report was issued from the Denver <br /> office of DRMS. <br /> The operator's representative reported that the longwall was active in Panel 18 and development work <br /> was in progress for panel E-1. <br /> Hydrologic Balance <br /> Mine water was not being discharged into Sylvester Gulch from outfall 017. <br /> General Mine Plan Compliance <br /> The operator appeared to be following the approved mine plan. <br /> Revegetation <br /> Vegetation has only recently greened up on the site,as snows came late this year. Weeds have not yet <br /> appeared. The operator's representative explained that the mine will follow its regular summer weed <br /> spraying program. <br /> Slides and Damage <br /> The access road in the area where tension cracks formed on the southwest corner of the Sylvester <br /> Gulch shaft construction laydown area(reported in last month's inspection)have been repaired and the <br /> road has been repaired. <br /> The operator's representative explained that geotechnical investigations continue for the slide above <br /> the portal bench(noted in April and May inspection reports). <br /> The small slide across the access road from the Lower Refuse Pile (noted in the April inspection <br /> report)has been regraded. <br /> 3 <br />
