III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made during
the inspection. Comments also describe any enforcement actions taken during the inspection and the
facts or evidence supporting the enforcement action.
This was a partial inspection conducted by Tom Kaldenbach of DRMS. Henry Barbe of Mountain
Coal Company represented the operator. Selected photographs taken during the inspection are
attached to the end of this report. With the operator's consent,this report was issued from the Denver
office of DRMS.
The operator's representative reported that the longwall was active in Panel 18 and development work
was in progress for panel E-1.
Hydrologic Balance
Mine water was not being discharged into Sylvester Gulch from outfall 017.
General Mine Plan Compliance
The operator appeared to be following the approved mine plan.
Revegetation
Vegetation has only recently greened up on the site,as snows came late this year. Weeds have not yet
appeared. The operator's representative explained that the mine will follow its regular summer weed
spraying program.
Slides and Damage
The access road in the area where tension cracks formed on the southwest corner of the Sylvester
Gulch shaft construction laydown area(reported in last month's inspection)have been repaired and the
road has been repaired.
The operator's representative explained that geotechnical investigations continue for the slide above
the portal bench(noted in April and May inspection reports).
The small slide across the access road from the Lower Refuse Pile (noted in the April inspection
report)has been regraded.
