111. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Reclamation, Mining, and Safety (Division). This mine site is currently finishing the final <br />stages of reclamation of disturbed areas. Ground conditions were very dry in all areas and <br />the weather was warm and breezy. <br />Availability of Records <br />The public copy of the mine records is kept at the office of Peak Project Management (PPM). <br />The contact, address, and phone number for PPM is Ron Thompson, Peak Project <br />Management, 34115 County Road 20.8, Trinidad, CO 81082, 719-846-4975. Records were <br />found in compliance as detailed on page 2a of this report. <br />Signs and Markers <br />The mine identification sign has been removed and will be replaced by a new sign indicating <br />the information required by Rules 4.02 and 4.30.2. The recently approved permit transfer to <br />New Elk Coal Co LLC is in the thirty day public comment period. New signage will display <br />the name and address of the new permittee along with other required information. <br />Hydrologic Balance <br />With the exception of pond 5, <br />sediment ponds remain dry to <br />the lack of meaningful rainfall <br />over the last two months. <br />Including maintenance <br />identified in the previous <br />inspection, the operator should <br />consider measures to reduce <br />downcutting in permanent <br />drainages above Fill 7 (shown <br />at right). Check dams spaced at <br />50-75 foot intervals may be an <br />option to consider. <br /> <br /> <br /> <br /> <br /> <br /> <br />r 4" <br /> <br /> <br /> <br /> <br />The steep riprap section of <br />ditch leading to pond 9 could <br />also use some work to prevent <br />side cutting and undercutting of reclaimed areas above the pond (see below)
