Public Notice <br />After reviewing your copy of the public notice that was sent to the Owners of Record of <br />the surface and mineral rights of the affected land, and the Owners of Record of all land <br />surface within 200 feet of the boundary of the affected lands and the notice that was <br />published in the local news paper, it was determined that the notice did not contain all the <br />information the Division requires the notice to be composed of. The published notice and <br />the notice sent to the land owners must contain the following information, pursuant to <br />Rule 1.6.2 (1) (d): <br />"(i) Name and address of Applicant; <br />(ii) Location of the proposed mining operation by section, <br />township and range and street address where applicable; <br />(iii) Proposed dates of commencement and completion of the <br />operation; <br />(iv) Proposed future use of affected land; <br />(v) Location where additional information on the operation may be <br />obtained; and <br />(vi) Location and final date for submitting statements of support or <br />objections with the Office." ( The office is the Division of <br />Reclamation Mining and Safety) <br />By June 291n, 2008 please re-publish a corrected public notice in a newspaper of <br />general circulation in the locality of the proposed mining operation. Also, in <br />accordance with Rule 1.6.2 (e), immediately after the first newspaper publication, <br />please re-mail or personally serve a copy of the notice described above to all <br />Owners of Record of the surface and mineral rights of the affected land, and the <br />Owners of Record of all land surface within 200 feet of the boundary of the <br />affected lands. Please provide proof that the notice was published in a local news <br />paper, and provide the receipts of Certified mailings or proof the notice was <br />personally served to the appropriate parties. <br />The public must submit written comments, protests or petitions for a hearing to <br />the DRMS no more than ten days after the last date for the newspaper publication. <br />I have enclosed an example of a proper public notice. <br />Additional Information Needed <br />Enclosed is a letter from the Division of Water Resources of the State of Colorado that <br />was received by the office in relation to the mining operation. Please address their <br />comments and concerns.
