Sherman <br />lr.Aecu lve DlrCltllr <br />Dick ljlfi T.E <br />Director , <br />As we discussed in our phone conversation earlier today, this office cannot <br />process the above-referenced applications without the required filing fees. However, <br />only one well permit is required for the total water surface area exposed by mining; so <br />long as such total area is included in the mining permit area. Please revise one of the <br />original applications as appropriate and return it to this office with the non-refundable <br />application filing fee,. which is currently $100.00. <br />Please provide a summary of all anticipated uses during and after mining, and <br />t. 1-1., il.... ! ??. to L... 1-e.1 in o feet f e Q•-:.?p- inn <br />iiItnuue a+v annuall amounts to ue appropri?at6.a III <br />uCT i., WruW\uaIWI1y IIwIW 1ai <br />lost in the mined product, etc.). <br />The provisions of Colorado Revised Statute 37-90-1372) prohibit the issuance of <br />a permit for a well to be located within 600 feet of any existing well, unless the State <br />Engineer finds that circumstances so warrant after a hearing held in accordance with the <br />procedural rules in 2CCR 402-5. This hearing may be waived if you are able to obtain <br />statements from owners of all wells within 600 feet, verifying that they have no objection <br />to your well being located within 600 feet of their wells. A field inspection must be <br />performed to be sure that no wells are missed (for example, unregistered wells may also <br />exist within 600 feet). No waiver of objection is required for existing wells owned by the <br />applicant.
