III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br /> and Safety. Mr. Brian Watterson of Twentymile Coal Company accompanied the inspection. The mine <br /> is an active underground mine. The weather was cool, windy and cloudy. <br /> Roads: Roads throughout the mine were dry and well graded. 6MN access road remains in good <br /> condition. No additional work at the Fish Creek crossing has been necessary. The water level in Fish <br /> creek has dropped well over a foot since the May inspection, and was well within the main Fish Creek <br /> channel. No additional road base material has been removed from the Fish Creek floodplain. TCC will <br /> need to submit a revision to the permit documenting the additions to the roadway. <br /> Hydraulic oil spill on the 6MN pad near the pump house continues to be cleaned up. The area around the <br /> 6MN pump house has been graded, but hydraulic oil continues to leak from the pump house. TCC <br /> continues to maintain an absorbent boom and napkins in the inlet of the 6MN pond. This is proving <br /> effective in keeping the material away from the south east side of the pond. <br /> TCC has graded the 6MN pad where snow was pushed this past winter. This grading looks good. Dirt <br /> that had been pushed off the 6MN pad on the Northwest side adjacent to the shaft heater propane tank <br /> still needs to be pushed back with in the pad drainage perimeter. <br /> Haul roads & access roads throughout the site are in good condition. Grading to establish good drainage <br /> is still needed to the south of Wash Plant 11 (New Wash Plant). Road drainage from Haul Road B runs <br /> into Foidel Creek near pond B with minimal settling of the sediment form the roadway. Rock check dam <br /> in this location still needs clean out. <br /> Processing Waste: The refuse pile is dry and actively having additional waste material placed on it. <br /> TCC has begun to grade out the center portion or the pile where material had been piled through the <br /> winter months. This work is progressing nicely. East facing slopes of the waste pile look good. <br /> Hydrologic Balance: Ponds throughout the mine site were holding water. <br /> TCC removed the pump from the 6MN pond last week according to the operator. TCC is working with <br /> the CDPH&E to permit this pond with an outfall point. This change to the pond configuration will also <br /> need to be permitted with DRMS. TCC needs to continue to clean up and monitor this spill. There was <br /> no sign that Hydraulic oil escaped the 6MN pond. <br /> Ditches through out the mine site are in good condition. The breach in the Refuse Pile West ditch has <br /> been adequately repaired. Seeding of the repair area and temporary water diversion area is needed. <br /> No clogged culverts were found.
