M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection of the Roadside Portals Mine conducted on May 29, 2008 by Mike <br /> Boulay of the Division of Reclamation, Mining and Safety Grand Junction Field Office. Tonya <br /> Hammond of Snowcap Coal Company(SCC) was present during a portion of the inspection at the 2- <br /> West Portal and North Decline areas. Weather conditions were sunny and warm. Ground conditions <br /> were dry. <br /> Availability of Records <br /> The availability of records was checked on the afternoon of 5/29. All required records were on file and <br /> available for review at J.E. Stover&Associates offices. No problems were noted with the records <br /> review. See the attached Availability of Records checklist. <br /> Roads <br /> Roads were dry and in good condition. Road ditches and road culverts were generally well maintained <br /> throughout the various mine site locations and support facility areas. <br /> Hydrologic Balance <br /> Sedimentation Ponds 6, 7,8,9,10,11, and 13 were all dry. Pond embankments, inlets and discharge <br /> structures were all stable and no problems were noted at any of the sediment pond locations. Drainage <br /> and diversion ditches were stable and dry with no significant erosion or other problems noted. Only <br /> the North Collection Ditch at the South Portals area had a small amount of water flowing in it which <br /> originates from the South Portals French Drain. <br /> The South Portal drainage pipe that extends out of the sealed South Portal had previously been leaking. <br /> Technical Revision No. 56 was recently approved and provides a plan to completely seal the pipe. <br /> Since the last inspection the pipe has been sealed in accordance with the approved plan. SCC capped <br /> off the end of the pipe and encased it in approximately two cubic yards of concrete. The site was then <br /> backfilled. The repair was successful and the pipe is no longer leaking and the location is dry and <br /> stable. The South Portal drainage pipe repair location is shown in the attached photo at the end of this <br /> report. <br /> Support Facilities <br /> The entire South Portal reclaimed area remains stable and in good condition. There were no signs of <br /> erosion or instability. The facilities area(former shop and warehouse) and perimeter locations at the <br /> South Portal were well maintained and no problems were noted during this inspection. <br />
