This is a report of findings and a request for information as a result of an internal review of the
Hayden Gulch, C-80-003 Applicant Violator System (AVS) databank and internal files. In this
memo, requests for documentation means letters of appointment, letters of resignation, minutes of
board meetings, etc. [A number of Secretarial Certificates are in the Colorado Department of
Minerals and Geology (CDMG) AVS files. In general, they suffice. However, precise start dates
are needed (month, day, year) and termination or end dates are needed (none were provided).]
The last identification of interests [Rule 2.03.3(3)] information in the CDMG A.VS files was
submitted under Terramatrix letter of July 25, 1995, with revised permit pages annotated 7/24/95.
Attachment 1 is a schematic of organizations that "owns or controls" the applicant according to
information in the AVS databank.
Attachment 2 is a printout (H G Coal Co) from the AVS databank as of December 3, 1998.
Information on this printout is consistent with the Terramatrix letter except for the appointments of
05/10/1996. In this regard, the information in the application should reflect current appointments
(page 2.03.4-1). Please let me know, with documentation, if and when (month, day, and year) the
appointment of R D Usilton as president has been terminated (see appointment of A C Pierce on
05/10/1996). Please provide documentation in support of any other changes that need to be made
(any other terminations or new appointments). Please advise if the begin date of Coalgrace Inc and
Coalgrace II Inc. as shareholders is the same as the begin date as partners. If so, I will add the dates
to the databank.
With regard to Attachment 3 (Coalgrace Inc., 2 pages), please review the identification of interests
information, and provide documentation for any corrections. AVS information is not consistent with
information in the Terramatrix letter. For example, the AVS information is that there are two
