8) Per Rule 6.2.1, all maps must be prepared and signed by a registered land surveyor, professional engineer, <br />or other qualified person; date prepared must be shown. Please submit a Mine Plan map and Reclamation <br />Plan map that are signed and dated by the map maker. <br />Maps received by the Division to this date have been adequate to describe general details associated with <br />the proposed mine. The requested maps and figures regarding issues related to hydrology must be signed <br />by a qualified engineer/hydrologist to insure that the content of the figures provide accuracy and the <br />required technical detail. <br />9) Please supply the Division a copy of the well permit or well permit number of the well permit obtained for <br />the mining operation. <br />Response: Copy of permit supplied to Division. <br />Response provided is adequate. <br />10) Will affected land of the proposed mining operation be within two hundred feet of State Highway 394? If <br />so please provide a signed damage agreement or an appropriate engineering evaluation that demonstrates <br />that the highway shall not be damaged by activities occurring at the mining operation. <br />Response: No mining will be within 200' of the deep cut ditch or State Highway No. 394 until a damage <br />agreement or engineer's letter of stability can be produced. <br />Per Rule 6.4.19, the applicant must either provide a notarized agreement with the owner of the Deep Cut <br />Ditch and State Highway No. 394, or submit an appropriate engineering evaluation that demonstrates that <br />the structures shall not be damaged by activities occurring at the mining operation prior to permit <br />application approval. <br />11) Will affected land of the proposed mining operation be within two hundred feet of Deep Cut Ditch? If so <br />please provide a signed damage agreement with the owner of the Deep Cut Ditch or an appropriate <br />engineering evaluation that demonstrates that Deep Cut Ditch shall not be damaged by activities occurring <br />at the mining operation. <br />Response: No mining will be within 200' of the deep cut ditch or State Highway No. 394 until a damage <br />agreement or engineers letter ofstability can be produced. <br />Refer to Rule 6.4.19 and the Divisions response to adequacy item 10. <br />Other issues may arise as more information is supplied. The decision date for this application has been set for <br />June 10, 2008. Judging by the issues brought up in this letter, the June 10, 2008 decision date will not allow <br />adequate time for staff review.
