Response: Monitoring wells will be placed between proposed pit site and closest wells and monitored for
water levels along boundaries of adjacent lands.
Please provide the Division with 5 quarters of groundwater level measurements prior to any dewatering,
to determine the seasonal fluctuations in groundwater levels. Please inform the Division of what the
proposed trigger point will be to indicate that mitigation measures will need to be implemented (how
much below the seasonal water level will indicate that mitigation needs to occur). What mitigation
measures will be implemented in the event that the trigger point is reached?
3). Per Rule 6.4.4 (c), please provide more detail as to which direction the water will flow during mining and
what methods will be used to de-water during mining operations. Please clarify where water from the mine
will be discharged and provide an affidavit that indicates that the operator has consent to discharge water
into the proposed water conveying structure.
Response: Please see enclosed map produced for discharge permit application to the Colorado Dept. Of
Health.
Response provided is adequate.
4) Per Rule 3.1.10 (5), to insure the establishment of a diverse and long lasting vegetative cover, the operator
shall employ appropriate techniques of site preparation and protection such as mechanical soil conditioning
by discing and ripping; mulching; soil amendments and fertilizers; and irrigation. What methods will the
operator employ to insure successful establishment of vegetation.
Response: Ground will be disc drilled and watered to insure successful establishment of vegetation.
Response provided is adequate.
5) Please clarify the estimated timeline and proposed reclamation of Phase 2.
Response: Estimated pit life for Phase I and Phase 2 will be 4-6 years before reclamation is complete.
Response provided is adequate.
6) Per Rule 3.1.8, all aspects of the mining and reclamation plan shall take into account the safety and
protection of wildlife on the mine site. What procedures and/or agreements will be implemented by the
operator to address the Colorado Division of Wildlife's recommendation for a seasonal closure of the
mining operation between the dates of January 1 through March 31?
Response: Mining operations will be suspended from January I - March 15
Response provided is adequate.
7) Per Rule 6.4.5 (2)(O(iv), indicate the quantity and size of the cottonwoods and willows to be planted along
the edge of the reclaimed pond.
Response: Size of Cottonwoods will range from 36" - 48" and will be planted at 4 trees to 100'
It is assumed that 36"- 48" Cottonwoods have an approximate diameter of 2", please confirm this. Also,
please clarify if 4 trees to 100' means every 100' there will be a cluster of 4 Cottonwoods or a
cottonwood will be planted every 25'. Also please indicate how many of these trees will be surviving
five years after planting.
