(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-2007-067 <br />INSPECTION DATE: 5/19/2008 INSPECTOR'S INITIALS THM <br />OBSERVATIONS <br />This inspection was a follow-up inspection of the Circle Dot Quarry Construction Materials mine site for the <br />approved 110c Permit application. The inspection was also conducted to determine if the cease and desist order <br />issued by the Division was observed by Marathon Oil Company. <br />The only activity taking place at the tune of the inspection appeared to be reclamation. Reclamation work was being <br />conducted in the form of hydro-seeding and installation of storm water BMP's. Reclamation activities are allowed <br />during a cease and desist order. <br />Topsoil appeared to be used for berm construction around the perimeter of the mine and as part of the storm water <br />settling ponds. Per Rule 3.1.9(1), where it is necessary to remove overburden in order to mine the construction <br />material, topsoil shall be removed and segregated from other spoil. Due to the topsoil being incorporated into an <br />erosion control structure the topsoil is not protected from deterioration and may be unusable for reclamation.
