Map 1, Surface Ownership and Map 2, Coal Ownership show all legal and equitable owners of •
record of the coal mined and all affected surface above the underground mining activities.
The State of Colorado has purchased the lands south of Highway 12 that include the permit
and disturbance areas. Access to these areas for the purpose of completing the final
reclamation of the mined lands has been secured by BRI though an exclusive use leaseback
agreement. There are no other purchasers of record under a real estate contract for property
overlying areas which BRI's mining activities will affect during the five (5) year permit term.

(3)(4) & (5) Basin Resources is a wholly-owned subsidiary of Westmoreland Coal Company,

corporate officers, directors and address and Employer Identification Numbers for Basin
Resources and Westmoreland Coal Company. Westmoreland owns or controls the surface
coal mining operations set forth in Table 3. No other applications are pending.
(6) & (7) All owners of record of all surface and subsurface areas which are contiguous to
the Golden Eagle permit application, or will be affected by surface operations and facilities
incidental to the Golden Eagle underground mining activities are shown on Map 1, Surface
Ownership and Map 2, Coal Ownership and further identified on Attachments 1A and 2A
enclosed with Maps 1 and 2.
