C
Gonzales, Nov 27,2004 p.6
Constitutional tort(*) and illegal.theft and removal
of mill equipment and buildings occured all during 2002,2003,
and 2004, while the plant was destroyed, wells destroyed, and
milling equipment, table concentrates, chemicals were confiscated
illegally and without due process of law, and removed from the
Joker claim. Orvie Zimmerman had sent M&K-TI, Ltd a registered
letter with return receipt cancelling their lease and prohibiting
equipment removal, but BLM actively encouraged the thefts and
removal of equipment without due process and against orvie's
outspoken wishes. Mr. Zimmerman told ire that Rob Ernst would not
listen to anything he had to say and just bulled his tray through
the equipment removal with threats and intimidations of reprisals
on Orvie's other mining property.
After reading the full file of letters to and from the
Colo DMG and several personal interviews with Mr. Orvie Zimmerman,
I would state as a mining expert with many years of practical experience
in the mining industry that the actions of Rob Ernst in fomenting
the above criminal conspiracy were not accomplished for a useful
public purpose that substantially advanced a state interest, but
were done out of spi,te.to inj-vre Orvie Zimmerman as much as possible
and to be as punitive as possible to the local placer mining industry.
Accordingly, each of the parties involved in the conspiracy
or that had anything to do with it should be charged for criminal
thefts amounting to. $ 4.61 million dollars.as listed:
rti C ?f?
