DEMAND FOR JURY TRIAL: (CON'T)
P9/9
BY PLAINTIFF IN THE ACTUAL DESTRUCTION of the Joker Mill and
in the financial and emotional distresses caused by threatened
BLM actions at the Ace#7 Mine. If the jury finds that individual
financial liability exists, it should apply jointly and severally
to all parties involved, according to the RICO laws(see list of
parties involved in my Nov 27,2004 letter to the U.S. Attorney
General ), just the same as threatened by the BLM in their Sept
17,2001 to operator M&MII, Orvie Zimmerman, and all family members
at other claims in the area.
I would expect the Court to act in accordance with the
findings and wishes of the Jury and under the guidance of the
actual Mining Law as expressed by Judge Kleinfeld in U.S. v Shumway
and in U=S--v Lex and"in Robbins v Willkie et al, 98-CV-201B, Federal
District Court of Wyoming, Jan 20,2004(Order for Jury Trial), and
the Federal Land Managment Act of 1977, which required "that only
resonable regulations for surface use be passed that do not interfer
with mining'. The present regulations, as enforced by Ernst,et al'.,
are totally unreasonable and should be overturned in their totality,
referring to 43CFR 3715 and 43CFR3809.
Terry Hankins, Plaintiff
P.O. Box 127, Baggs, WY 82321
Phone 970 583 7342
