Specifically with respect tothe destruction of <br />the Joker MIll and itsfinancial impact on my processing of <br />two million tons of proven ore on adjoining properties, I <br />request the juryto award both Orvie and me $1 per ton of ore <br />planned to be processed by the Joker Mill, now totally destroyed <br />and unavailable due to the conspiracy discussed in my letter <br />of Nov. 27,2004 to the U.S. Attorney General. This would be <br />in addition to requesting the BLM to return and rebuild the <br />Joker MIll, since it will take them some time to do that. <br />11. In the matter of the destruction of the Joker Mill <br />as well as the false reporting on the Ace#7 Mine, a question <br />11 <br />for the jury is: Did the BLM employees and others involved reach <br />a level of illegal interaction that constitutes extortion, punishable <br />under the RICO laws, where the result was an illegal act--that is <br />the premature destruction, or in effect theft such as occurred <br />at the Joker MIll Oct 31,2002 to Dec.14,2004 or potentially could <br />occur at the Ace#7 Mine as threatened by Rob Ernst in his 1999, <br />200 and 2001 inspection reports. Inspection reports for 2003 and <br />2004 have never been 'received from the BLM. The BLM in Craig also <br />has not responded to a Freedom of Information Act request for all <br />documents related to ,the Joker MIll destruction. <br />If the jury finds that extortion was involved in either <br />the Joker Mill destru''ction or the Ace#7 case, the jury should <br />recommend that all individuals involved(see Nov 27 letter), whether <br />BLM employees or otherwise, that contributed in any way to the <br />destruction of the Joker Mill or threatened destruction at the <br />Ace #7 Mine be removed from the veil of y?vernmental immunity <br />and subjected to personal financial liability for the losses incurred
