III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br /> and Safety. Mr. John Weinman of Hydro-Environmental Solutions, Inc. accompanied the inspection as <br /> the permittee's representative. The site is an inactive load-out. The operation is approved to operate as a <br /> load-in facility too, but construction of off loading structures has not commenced. <br /> Roads: The roads in the mine side are in good condition and do not require additional maintenance. <br /> Routt County is realigning Routt County road#37 near the Rail line crossing over the Walker ditch. A <br /> County contractor was working on the waterline crossing over the ditch and had staked re-alignment of <br /> the roadway. Since several stakes had been placed within the permit area boundary, we spoke with the <br /> contractor. He assured Mr. Weinman and the state inspector that the county road work would not occur <br /> within the permit boundary(within the fence). <br /> Three locations on the rail line have had road base material placed over the tracks at driveway or road <br /> crossings. Should the loadout reactivate,this material will need to be removed. <br /> Hydrologic Balance: Pond 1 (Truck loop pond)was holding water approximately 2"below discharge <br /> riser. The operator had previously resealed small leaks in the seams of the riser. The repairs appear to <br /> be effective. Pond 1 was not discharging. <br /> Pond 2 (Rail loop pond)was holding water but was several inches below discharge level. It appears that <br /> the pond discharged recently, and HGTI personnel have placed a 4" PVC pipe in the spillway to allow <br /> for ease of sampling the discharge. This pipe is placed in with soil from the embankment and does not <br /> impede any flow out of the pond. Water in Pond 2 appears fairly clear. A muskrat or beaver was <br /> observed in the pond. No sign of burrows at the waterline were apparent. Ditches are in good condition. <br /> Ditch 5 needs some additional clean out of sediment, but there was no evidence that runoff had left the <br /> ditch. Ditch 5 is still functional. Some material has sloughed near the outlet of culvert LFC-4, that <br /> should be removed. However, the culvert was running water and this material was not impeding the <br /> flow. <br /> As evidenced by the debris in the Dry Creek flood plain, Dry creek ran very high for a time this spring. <br /> No damage to the ponds, or HGDAL-3 appeared to have resulted form this high flow. <br /> Alluvial water monitoring wells: <br /> HGDAL-1: has been sealed and the location is marked with a steel post. <br /> HGDAL-2: has been sealed and the location is marked with a steel post. <br /> HGDAL-3: has not been sealed and is still used for monitoring. <br /> Culverts and ditches throughout the mine site appear to be in good condition. Culvert 15 under the rail <br /> road has been cleared on the outlet side but still has some sediment on the inlet. Water has flowed <br /> through this culvert without backing up on the inlet side.
