4of7 <br />requirements of state and federal law, which latter requirements, if more stringent than <br />these, shall control. <br />SECTION SEVEN <br />PAYMENT OF TAXES <br />Lessor shall pay all real estate taxes levied against the leased premises before they <br />become delinquent. If Lessor fails to pay the taxes, lessee may, at its option, pay the <br />taxes and assessments as may be levied against the premises, and deduct the amount of <br />the payments, together with any penalties or interest required to be paid, from any <br />amount subsequently due to Lessor. <br />SECTION EIGHT <br />REMOVAL OF IMPROVEMEN'T'S AND EQtTRWENT <br />All improvements and equipment placed on the leased premises by Lessee, except <br />water well casing, fences, gates, and cattle guards, shall remain the property of lessee. <br />Lessee shall have the right to remove such nonexcepted property prior-to the expiration <br />of this lease. <br />On termination of this lease for any cause, Lessee shall have the right to remove all <br />its improvements and equipment within a reasonable time, except water well casing, <br />fences, gates, and .cattle guards, but including any materials mined and produced, but <br />not removed on the date of tenmiinatiori, all subject to payment of royalties provided in <br />this lease. <br />SECTION NINE <br />INDIEMNYFICATION OF LESSOR <br />Lessee shall indemnify Lessor against liability, on all claims for damages and injuries <br />to persons or property that are claimed to have resulted from the activities or omissions <br />of Lessee or its agents or employees during the term of this lease, including costs of <br />llitiption and arbitration and attorney fees. Lessee shall provide Lessor no less <br />frequently than annually certificates of insurance showing general liability insurance. <br />coverage of Lessee for the leased premises. <br />SECTION TEN <br />DLFAULT BY LESSEE <br />any default occurs in the performance of any term or condition of this lease by <br />LeIfssee, Lessor shall be required to give a 45-day notice in writing to Lessee, demanding <br />the correction or removal of the default. <br />If Lessee fails to correct or remove the default within this period, Lessor may, at <br />Lessor's option, terminate this lease. <br />Lessee shall have thirty (30) days after the termination within which to remove any <br />nonexcepted plant, structures, and equipment placed on the leased premises by Lessee.
