3 of 7 <br />must be replaced to the stream system or aquifer from which withdrawn. <br />SECTION FOUR <br />DAMAGE TO LIVESTOCK, CROPS, AND IMPROVEMENTS <br />Lessee shall repair any damage to water wells, drinking troughs, storage tanks, and <br />other similar improvements on the leased premises. <br />Lessee shall pay the reasonable value of any livestock and crops that may be killed, <br />injured, destroyed or damaged by Lessee's agents or employees in the permitted use of <br />the leased premises. <br />SECTION FIVE <br />PROTECTION OF PREMISES <br />Lessee shall provide and install adequate gates and cattle guards at all entrances into <br />areas of the leased premises being used or occupied by Lessee. The gates will be kept <br />locked during the hours of darkness, and at all times when the areas are not occupied or <br />used by Lessee's personnel. " <br />SECTION SIX <br />PERM M,, PROTECTION AND RESTORA'T'ION OF SURFACE <br />Lessee shall be solely responsible for obta all federal, state and local permits <br />required for the removal or mh*tg of materials under this lease, at its own wgwnse, to <br />biclude without limitation any performance warranty or financial warranty, bond or <br />other form of undertaking for any such permit, and shall be solely respoiwible as the <br />operator to fulfill all duties imposed under any such permits, and shall indemnify and <br />hold harmless Lessor as provided in Section Nine of this lease. <br />In digging pits for the purpose of producing and removing materials,.Lessee shall <br />make separate stockpiles of topsoil and of waste substances. <br />Lessee shall properly control all distributed soils to prevent to the maximum extent <br />possible the blowing of dust and soils, and the erosion of soils by wind, rain, and <br />surface runoff. <br />On completion of operatims for the removal of materials from pits that have been <br />dug on the leased premises, Lessee will place any unused waste substances and <br />materials used for roadways back into the pits from which the substances and materials <br />were removed, with topsoil placed on top. Lessee will back slope the pits to a slope no <br />greater 3:1. <br />Before termination of the lease, Lessee shall plow, grade, and revegetate with native <br />grasses all areas where roads, and stockpiles and pits have existed, or where the <br />vegetative cover was damaged or removed. <br />The requirements of this section six are in addition to any reclamation
