I10 Permit Application <br />Colorado Division of Reclamation, Mining and <br />control blanket placed on the sides. Discharge of this water will occur on the down slope <br />side of the adjoining road. The surface water catchment uphill of the pit is small due to <br />diverging surface water flow paths. Surface flow beyond the culverts' discharge will <br />occur on a heavily vegetated slope for approximately 600 to 1,000 feet before entering <br />an established ephemeral drainage and/or will infiltrate into the ground. <br />Storm water accumulations inside of the active mining area will be directed to the storm <br />water retention basin located on the southern portion of the pit area. Gathered storm <br />water will be allowed to still, evaporate and infiltrate, or if sufficient quantities are <br />present, overflow the basin in a rocked outlet spanned by silt fence or similar material. <br />Additional best management practices will be used at the site to protect against the <br />release of significant quantities of sediments where the benefit of their use is evident. <br />(J) Rule: specify how you will comply with applicable Colorado water laws and regulations <br />governing injury to existing water rights. <br />Response: No appropriation of water is planned for the mining operation. As such, no <br />injury to existing water rights is anticipated. <br />(K) Rule: if refuse and acid or toxic producing materials are exposed during mining, describe <br />how they shall be handled and disposed of in a manner that will control unsightliness <br />and protect the drainage system from pollution. <br />Response: No refuse and acid or toxic producing materials will be exposed during <br />mining. Garbage generated at the site will be removed daily. Fueling of equipment will <br />occur from mobile tanks in pickup trucks. <br />(L) Rule: describe what measures will be taken to minimize disturbance to the hydrologic <br />balance, prevent off-site damage, and provide for a stable configuration of the reclaimed <br />area consistent with the proposed future land use. <br />Response: No appreciable change in the hydrology outside of the disturbance area will <br />occur as surface water will be routed around it. The area of disturbance is relatively <br />small and captured water will be allowed to settle and infiltrate or be discharged as <br />storage capacity is met. The existing disturbance area has historically been used as a <br />source of construction materials and the surrounding ranch was used for hunting and <br />limited timber harvesting. Portions of the site with low angle slopes will be reclaimed to <br />support vegetation species allowing for wildlife feed. The 1.2:1 slope is proposed to <br />remain as unvegetated bedrock due to the lack of available topsoil at the site. <br />(M) Rule: specify whether the deposit will be processed on-site. If the deposit will be <br />processed, then describe the nature of the process, facilities and chemicals utilized. The <br />process area and any structures must be described on Exhibit E - Map. <br />Response: A small rock crusher may be used at the site, if needed. The equipment will <br />be positioned on the eastern portion of the site. The equipment will be powered by a <br />generator using diesel fuel. Fuel will be delivered to the site via truck, as needed <br />(Exhibit E). <br />(N) Rule: identify the primary and secondary commodities to be mined/extracted and <br />describe the intended use. <br />Tetra Tech April 2008 (May 2008 Application Amendment Page) 10
