Submittal of the as-built drawings no later than 30 days after completion <br />of the final inspection. <br />Final acceptance of the project will be granted once the Completion Documents <br />are received and approved by this office. This Conditional Approval is in effect until <br />October 31, 2008, at which time a reassessment of the approval will be required, if final <br />acceptance of the project has not been issued. Please contact Steve Tuck, the Water <br />Commissioner for Water District 40 at (970)-249-6622 to find out when water is legally <br />available for storage in this reservoir. <br />As the owner of this facility, the Minnesota Reservoir and Canal Company is <br />liable for the safety of this structure and for any loss of life and/or damages caused by a <br />failure of the dam or appurtenant structures. Acceptance of the construction by this <br />office does not relieve the owner form this liability or from any other statutory obligations. <br />Therefore, it is in the owner's best interest to operate and maintain the facility in such a <br />manner that the safety of the dam and/or the general public is not jeopardized. <br />If you have any questions concerning this matter, please feel free to contact Paul <br />Perri in our Denver office at (303) 866-3581 ext. 8274. During the filling of the reservoir, <br />please keep Mr. Perri informed of the performance of the dam and appurtenant <br />structures and notify him in a timely manner if any adverse conditions develop which <br />could threaten the safety of the facility. <br />We appreciate the Minnesota Reservoir and Canal Company's efforts in <br />improving this facility for the storage of water in the State of Colorado. <br />Sincerely, <br />;Jack G.
