(Page 3) <br />MINE ID # OR PROSPECTING ID #: M-2007-067 <br />INSPECTION DATE: 5/6/2008 <br />INSPECTOR'S INITIALS THM <br />The following problems (PB) and/or possible violations (PV) (and suggested corrective actions) were identified during this <br />inspection. The problems should be corrected by the dates given, or they will become possible violations. The possible <br />violations should be corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation <br />Board. The inspector noted on the previous page should be notified of all corrective actions taken. <br />PROBLEMS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />CORRECTION <br />DATE <br />Marathon Oil Company conducted complete vegetation removal, stripping and stockpiling b(. Wa /OR <br />of topsoil and construction of stormwater diversion berms and settling ponds. A 0\4- r' <br />Construction Materials 110c Application was approved by the Division on January 18, Q'PXA <br />2008; however the financial warranty has not been received by the Division. The 110c <br />Mining and Reclamation Permit has not been issued by the Division. The Division believes <br />this is a possible violation of the Colorado Land Reclamation Act for the Extraction of <br />Construction Materials, C.R.S. 34-32.5-101 et. sect., and specifically C.R.S. 34-32.5-109(1) <br />as amended for failure to obtain a Mined Land Reclamation Board Reclamation Permit <br />before engaging in a new operation. <br />PB or PV: _PV <br />TOPIC(S): --Al3 <br />Corrective Action: - <br />Post a bond acceptable to the Division of Reclamation, Mining and Safety in the full amount of <br />$20,676.00 immediately. <br />I, Travis Marshall, hereby certify that on May 13, 2008, 1 deposited a true and complete copy of this foregoing inspection <br />report in the United States Mail, first class postage paid, to the operator of record for this site at the address indicated, <br />and to those others within the body of this report who have been designated to receive ie (DR personnel <br />excepted). <br />SigfaTure - - `--
