(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-2007-067 <br />INSPECTION DATE: 5/6/2008 INSPECTOR'S INITIALS THM <br />OBSERVATIONS <br />This inspection was a pre-operational inspection of the Circle Dot Quarry Construction Materials mine site for the <br />approved 110c Permit application. <br />Marathon Oil Company conducted complete vegetation removal, stripping and stockpiling of topsoil and <br />construction of stormwater diversion berms and settling ponds. The affected area appeared to be the total <br />allowable affected acreage of 9.11 acres. <br />A Construction Materials 110c Application was approved by the Division on January 18, 2008; however the <br />financial warranty had not been received by the Division. The 110c Mining and Reclamation Permit has not been <br />issued by the Division. The Division believes this is in violation of the Colorado Land Reclamation Act for the <br />Extraction of Construction Materials, C.R.S. 34-32.5-101 et. sec., and specifically C.R.S. 34-32.5-109(1) as <br />amended for failure to obtain a Mined Land Reclamation Board Reclamation Permit before engaging in a new <br />operation. The issue is scheduled to be on the June 2008 Mined Land Reclamation Board agenda. <br />The mine identification sign and affected area boundary markers were not observed and must be installed upon permit <br />approval per the requirements of Rule 3.1.12. <br />No permanent man made structures were located on site. <br />No exposed ground water was observed and none is expected to be encountered due to the location of the site. <br />The stormwater runoff catchments appear to drain within close proximity to the road that runs outside of the permit. <br />The current configuration of the BMP's appear to have potential to cause off-site damage if a major stormwater <br />runoff event were to occur.
