III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Bowie No. 1 Mine (Permit No. C-1981-038) conducted by <br /> Marcia Talvitie and Joe Dudash of the Colorado DRMS on 22 & 23 Apr-2008. Basil Bear, of Bowie <br /> Resources, LLC (BRL) was present during the records check. No representative of the operator <br /> was present during the field inspection. Reclamation work was continuing at the East Mine. The <br /> West Mine, Ponds W-1 and W-2, and Ponds 1 through 4 were accessed for the first time since <br /> heavy winter snows blanketed the area. <br /> Availability of Records <br /> Records were available for review at the BRL offices located at the Bowie No. 2 Mine. A <br /> completed "DMG Availability of Records Form" is attached. <br /> Signs and Markers <br /> Mine and Permit Identification Signs containing the information required by Section 4.02.2 were <br /> posted at the entrances to the East Mine, the West Mine, the Well Field, and the Train Loadout <br /> Area. Surface Disturbance Markers were observed at all locations, as required by Section 4.02.3. <br /> Roads <br /> The road to the West Mine was passable to narrow vehicles with high clearance (fallen rocks to <br /> avoid and a running creek to cross). Roads to the R.O.M. Coal Storage Pile and the Well Field <br /> were dry and well-graded. The East Mine road was graded and in good condition from Stevens <br /> Gulch Road to the Fan Bench, and access to the pond areas of the east mine was easily <br /> accomplished. The road to the Highway Coal Storage area was passable; roads within the Train <br /> Loadout were clear and dry. <br /> Hydrologic Balance <br /> Ponds W-1 and W-2 at the West Mine were accessible for the first time this spring. Pond W-1 was <br /> dry; however, vegetation in the bottom of the pond gave indication that water may have been <br /> present earlier in the season. Pond W-2 contained water, and the level was below the outlet <br /> pipe. Embankments for both ponds appeared to be stable, and outlet structures functional. <br /> Activity at the R.O.M. Pile was being conducted in such a way that any surface runoff would <br /> continue to be directed to the Timber Storage Area Sedimentation Pond. This pond did contain <br /> water. The West Ridge Pond was dry, as were Ponds 1, 3 and 4. Pond 2 held a small amount of <br /> water. <br /> Backfill & Grading <br /> Work was progressing on the transfer of material from the R.O.M. Pile to the East Mine (Figure 1). <br /> The majority of the coal-rich top layer had been hauled to and placed in the excavation <br /> prepared at the uphill end of the West Ridge Waste Pile. The remainder of the coaly layer still <br /> held snow and ice, and had been pushed aside to dry out before being transported. A track- <br /> mounted excavator was loading a series of five articulated haul trucks with material from the <br /> R.O.M. Pile. The trucks. carried their loads across Stevens Gulch Road (traffic control was in <br /> place) and up the Haul Road to the Crushing and Screening Bench, where the dumped <br /> material was being worked by a bulldozer (Figure 2). <br /> Bowie No. 1 Mine C-1981-038 22-Apr-2008 <br />
