III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Tom Kaldenbach of DRMS. Henry Barbe of Mountain <br /> Coal Company represented the operator. Snow had melted from the site and the ground was dry. <br /> Photographs taken during the inspection are attached to the end of this report. With the operator's <br /> consent,this report was issued from the Denver office of DRMS. <br /> The longwall was active in Panel 18. Development work was in progress for panel E-1. <br /> Availability of Records <br /> All required records were on file in the mine office (see attached list). <br /> Signs and Markers <br /> Mine i.d. signs were properly displayed at the two entrances on Highway 133. Topsoil markers were <br /> properly displayed on topsoil stockpiles seen during the inspection(as listed in the discussion of <br /> Topsoil, below). Stream buffer markers were in place in Sylvester Gulch. The affected area boundary <br /> was properly marked by signs around the perimeter of the disturbed area in the main surface facilities <br /> area. <br /> Roads <br /> Road surfaces, embankments, and road ditches and culverts were in good repair in the main surface <br /> facilities area and in Sylvester Gulch. <br /> Hydrologic Balance <br /> The following sediment control ponds contained water, but were not discharging: M13-2R(outfall <br /> 004), MB-3 (outfall 005), SG-1 (outfall 014), and MB-4 (outfall 008). The discharge structures, <br /> embankments, and inslopes of these ponds appeared in good condition. <br /> Clear mine water was being discharged into Sylvester Gulch from outfall 017 at a rate estimated to be a <br /> few cfs. The mine water was mixing with natural flow from the east fork of Sylvester Gulch. Natural <br /> springs were flowing from colluvial material on hillsides in Sylvester Gulch. <br /> Unlined ditches next to Sylvester Gulch Road and around shaft sites in the Gulch were in good repair. <br /> The operator's representative explained that a consultant will be conducting a preventative <br /> maintenance survey of ditches on the site. <br /> 3 <br />
