PROMISE TO CORRECT <br />Scott R. Brennise and Sheila M. Brennise as owners of 4B Land & Livestock, LLC, <br />whose mailing address is 5801 Highway 394, Craig, CO 81625, pursuant to Rule 6.3.12 <br />of the Construction Materials Rules and Regulations, State of Colorado, Division of <br />Reclamation, Mining & Safety (DRM&S) do hereby agree to provide compensation to <br />the Deep Cut Ditch Shareholders Association for any damage to structures, including <br />damage repairs to man-made structures within 200 feet of the affected area and related to <br />the mining of the property located South of the Yampa River, described in the Warranty <br />Deed dated January 4, 2008 from Robert Edwin Duzik to Scott R. Brennise and Sheila M. <br />Brennise, and recorded January 7, 2008 as Reception No. 20080079. <br />Permanent structures owned by the Deep Cut Ditch Shareholders are within 200 feet of <br />the land to be affected and consist of the following; <br />• Irrigation Ditches & Gates <br />• Fences & Gates <br />• Ditch Service/Access Road <br />The terms hereof shall be binding- upon. and. inure to.the benefit of the heirs, executors, <br />administrators and assigns of the respective parties hereto. <br />SPECIAL CONDITIONS: NONE <br /> <br />Scott R.
