Box 53 Natural Resource Trustee <br />Saguache, Colorado 81149 <br />Re: Flying Triangle Ranch Pit, 112c permit Application No. M-2008-018, Reclamation Liability Estimate. <br />Dear Mr. Scanlon, <br />The Division of Reclamation Mining and Safety has received TMS Consulting response to staff review of the <br />above referenced application. It appears that all issues have been addressed to meet the minimum requirements of <br />the Act and Rules. Staff notes the public comment period expired on May 14, 2008. No comments of opposition <br />were received. Therefore, the final step prior to a decision is the agreement of the reclamation liability estimate. <br />Please find enclosed the Final Reclamation Liability Estimate prepared by DRMS. The estimate is similar to that <br />provided within the application with the exception of one task. The worst case scenario based on the proposed <br />plans would need to include the establishment of a 3:1 slope on an excavation bench and revegetation of the <br />slope. Overall the additional task amounted to a minimal increase over the supplied estimate in Exhibit L. Also, <br />it is important to note that this does not include any disturbance for additional soils in the east half of the proposed <br />site. Since the amount of area is unknown the Division will adjust the bond as this area is disturbed and the <br />operator will need to note such disturbances within the annual report. <br />Staff has calculated the reclamation liability to be $12,681.00. Please review the estimate and contact staff <br />immediately if there are any discrepancies or errors that might affect the overall costs.
