New Horizon Mine C-1981-008 16-Apr-2008 <br /> III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Marcia Talvitie of the Colorado DRMS. Tom Fry <br /> represented the operator, Western Fuels-Colorado (WFC) during the inspection. <br /> Signs and Markers <br /> A Mine Identification Sign was posted at the entrance to the permit area near the office and <br /> support facilities. Topsoil piles east of the active pit were marked with signs designating their <br /> sources: "B" and "Mixed". <br /> "Blasting Area" signs are posted along the county road right-of-way fence along the Benson- <br /> West parcel. <br /> Roads <br /> WFC has hired a contractor to perform grading of the 2700 Road alignment, which passes <br /> directly through the permit area from north to south, and the BB Road alignment, heading east <br /> from its intersection with 2700 Road (Figures 1 and 2). WFC plans to place aggregate base <br /> course on the two roads this year, and open them to public use. Paving with hot mix asphalt is <br /> anticipated to occur in a future year. <br /> Other roads within the permit area were dry and in good condition. <br /> Hydrologic Balance <br /> Pond 009 contained a small amount of water at the northeast corner, considerably less than <br /> what was observed during the Mar-2008 inspection. Within the active mine, water was <br /> accumulating (due to a structural change in the subsurface geology) a distance north from the <br /> southern limit of the excavation (Figure 3). Mine water continues to be pumped to Pond 007. <br /> The CC Ditch had not yet been turned on; the ditch bottom of the West Lateral was completely <br /> dry. <br /> Backfill & Grading <br /> Articulated trucks were hauling rock from the most recent blast out of the pit and dumping it into <br /> the pit from the east. <br /> Support Facilities <br /> Support facilities inspected included the warehouse, material storage building, tire storage, <br /> shop, yard area, and fuel storage facilities. The site houses a number of 55-gallon drums, many <br /> of which have secondary containment. Within the material storage building, drums are clearly <br /> labeled; several drums that appeared to be newly delivered were not placed within secondary <br /> containment (Figure 4). A number of empty steel drums have accumulated behind the material <br /> -1- <br />
