Cattany <br />Division Director <br />Mr. Kerry Halde Natural Resource Trustee <br />Halde Sand & Gravel, INC <br />46321 US Highway 24 <br />Burlington, Colorado 80807 <br />Re: M-2008-014 Construction Materials Application Adequacy comments <br />Dear Mr. Halde <br />The Division has reviewed your 112 application and has the following comments. <br />I) Exhibit "A", "B" & "C" Adequate. <br />II) Exhibit "D" Mining Plan <br />A) According to the new updated surveyed map of the permit area, it now includes the small area <br />that was affected prior to the submitted of the 112 application. <br />B) The applicant states that "the Landsman Creek Runs north to south to the east of the mining <br />operations. The mining activities will not affect the Creek. All mining will stop within 50 feet of the <br />Creek". The fifty foot buffer for a dry Gulch that flows in association with a measurable <br />precipitation is acceptable. However, during the site pre-operational inspection you had indicated <br />you might remove materials from the Creek as is the case with most of the operations in the <br />county. If such is the case, it will be to your advantage to provide the cross- section of the stream <br />showing the elevation of the invert of the channel. Such demonstration would allow the operator <br />to demonstrate how they will reclaim the river with out drastically affecting the embankment. It <br />might also require a permit from the Army Corps of Engineer. <br />C) The operator states the size of the area to be worked at one time is approximately 10 acres. The <br />area will be mined from North to South in 10 acre phases. There will be approximately 10 acres <br />phases every 4 years with reclamation taking place in the 5~ year. Does the 10 acre maximum <br />disturbance include, stock pile & equipment storage areas or mining acres. Please explain. <br />D) Based on what is stated in the application the total depth of the alluvium deposit is, top soi14-6 <br />inches ,sand and gravel 6-t0 8 feet, for a total maximum depth of 81/2 feet. In other words, the <br />maximum high wall for the pits will not exceed 9 feet.
