<br />N. Noland Inc. The Cedar Point Pit and its permit area is operated by Sky Ute Sand and Noland Inc.
<br />Gravel Pit Gravel. This property shares the entire western boundary of the permit area
<br /> and various portions of the site, including buffer zones, fencing, storage
<br /> areas (for equipment, materials, and wastes), and possibly some mined
<br /> areas are located within 200 feet of affected lands.
<br />Evaluation Fencing between the two properties is in fair to poor condition. While not permanent structures,
<br /> materials, equipment, and wastes stored within 500 feet of the affected areas, as visible from the permit
<br /> area, do not appear to require special considerations for stability or to impose loads or other impacts
<br /> which requires any special provision in mining or reclamation. All permanent structures appear to be at
<br /> least 200 and probably 500 feet from the affected lands. Although some weeds are present, there does
<br /> not appear to be a significant problem on either property. There is no erosion onto Noland property
<br /> from excavations of the existing piton the permit area. The Noland property is downslope from the
<br /> permit. area before mining, and is protected from problems with excessive drainage or sedimentation by
<br /> a large rock check dam and basin at the old pit, constructed right at the property line. Mining and
<br /> reclamation plans provide for adequate protection against erosion or sedimentation, and storm water
<br /> management plans should adequately address quality and quantity of discharged storm water, as
<br /> properly implemented. See separate discussion of fencing (M).
<br />Conclusion and There is no significant impact on the Noland property and any permanent structures on it, from mining
<br />recommendations operations in the permit area, due to distance and terrain. Existing storm water controls and fencing
<br /> should be maintained and improved. If possible, operations should be coordinated with the Noland Inc.
<br /> pit to the west to allow highwalls and reclamation slopes to be reduced and all materials recovered.

<br />On-site structures On the property being permitted, there are various unimproved roads and Landowner
<br />and improvements trails, irrigation lateral ditches, fences for pastures, and drainage controls.
<br />These are all considered, by the landowner, to be temporary and not
<br />permanent in nature. New roads as built (or reconstructed) will be
<br />considered permanent in nature, as stated in mining and reclamation plans.
<br />New plant sites will include permanent structures as they are built, including
<br />buildings, utilities, landscaping, and storm water control systems.
<br />Evaluation There are no permanent structures which will be retained; therefore, there is no potential for impact.
<br />New permanent structures will be built with consideration of on-going mining and reclamation
<br />operations. Road, lateral ditches, and drainage features will be constructed as mining and reclamation
<br />progresses.
<br />Conclusion and There is no impact expected to permanent structures other than that intentionally planned and
<br />recommendations executed. '
<br />4. Based on my review, there is no need for additional slope analysis or evaluation at this time.
<br />5. There are no documented or observed geological hazards on the site or in the vicinity to the site which have the
<br />potential to affect any proposed impoundment, slope, embankment, highwall, or waste pile within the affected area.
<br />Therefore, there are no geological hazards that might be de-stabilized or exacerbated by mining.
<br />6. This report is submitted in lieu of Attachment S-1 to Exhibit S.
<br />7. It is my professional judgment that the mining operation will NOT adversely affect the stability of any significant,
<br />valuable and permanent man-made structure located within two hundred (200) feet of the affected land, in
<br />accordance with the requirements of Rule 6.4.19 (b).
