Structure Description/notes Owner <br />B, C, and D Stock A series of three stock dams located along a drainage upstream of most of Neva, Catherine <br />Dams the permit area. Dam impoundment areas are 1.1, 0.5, and 0.8 acres 38861 US 160 <br /> respectively, with dam crest height of approximately 8 feet, and maximum <br /> depth estimated at 7 feet. Located within 200 feet of affected area. <br />Evaluation Based on depths and size, all are non-jurisdictional dams with less than 10 foot crest height, less than <br /> 10 acres of surface, and less than 100 ac-ft capacity; coordination with Matt Gavin, Dam Safety <br /> Inspector for Water District 7, Durango indicates that there is no record of the dams. Dam failure would <br /> create minor flooding and potentially some erosion and sedimentation downstream but will not threaten <br /> any structures for at least'/< miles downstream on Mud Creek. Total water released would be roughly <br /> equal to 25-year, 24-hour storm event on the tributary of Mud Creek into which this drainage flows. All <br /> dams have significant seepage, feeding the wetland areas located downstream on the permit area. <br /> See detailed discussion in Attachment 1 to Exhibit S. <br />Conclusion and This structure will not be damaged by proposed operations. Proposed operations both upstream and <br />recommendations downstream are not expected to have any impact on functionality or stability of the dams. <br />Structure Description/notes Owner <br />E. Unimproved Immediately adjacent to the east permit boundary, and within 200 feet of Neva, Catherine <br />roads/trails and affected area, are a series of unimproved roads and trails used by the 38861 US 160 <br />irrigation ditches property owner to go to and from the cropland and the stock dams, and <br />(laterals). several lateral irrigation ditches. Roads are 8-10 feet in width, have some <br /> gravel but are mostly dirt, and have no drainage structures or ditches. <br /> Irrigation ditches are not more than 18 inches deep and 36 inches wide, <br /> unlined. There are no fences on this property line. <br />Evaluation Based on proposed mining and planned slopes, proposed operations in the mining permit area are not <br /> expected to have any impact on these structures, which are proposed to remain in use. Landowner <br /> and operator may agree to construct a permanent fence along this permit boundary, but no impact on <br /> that fence, if constructed, is likely. <br />Conclusion and These structures will not be damaged by proposed operations. Property line shall be clearly delineated <br />recommendations prior to beginning mining operations, <br />Structure Description/notes Owner <br />F. Bohio A bohio (a open-sided structure with a peaked roof) is located in one of the Landowner <br /> pastures inside the permit area. It is located more than 200 feet but less than <br /> 500 feet from the affected land. There are internal and external pasture <br /> fences located in its vicinity. <br />Evaluation During mining operations, fences may be removed or relocated as part of normal farming activities only <br /> indirectly related to mining. Landowner does not consider these to be permanent structures. <br />Conclusion and The bohio and nearby fencing will not be damaged by proposed operations, based on location and <br />recommendations nature of construction. <br />Structure Descriptionlnotes Owner <br />G. Homestead The Neva homestead, which was the farm headquarters for both the permit Neva, Catherine <br /> area and the adjacent property to the east prior to dividing the property, is 38861 US 160 <br /> located 500 feet or more from the affected land. There are fences, <br /> outbuildings, and landscaped areas located within 500 feet but more than <br /> 200 feet from affected land. <br />Evaluation The terrain and the distance from affected land protect these permanent structures from any significant <br /> physical impact. The south buffer zone was laid out in part to ensure that there was no impact on this <br /> property. All operations are downslope. <br />Conclusion and The bohio and nearby fencing will not be damaged by proposed operations, based on location and <br />recommendations nature of construction. <br />
