management practices (scraper road water bar locations) may have contributed to gully <br />erosion and to slope instability. The soil spreading/grading technique and lack of <br />subsequent seedbed preparation roughening appears to have resulted in accelerated rill <br />erosion. The toe of the slide has encroached into Pond 12, reducing storage capacity of <br />the pond by some extent. The slope failure and erosion on the slope have contributed to <br />high levels of settleable solids being discharged from Pond 12 (0.9 ml/1, on 4/22/08). <br />STEPS NECESSARY TO ABATE VIOLATION (REMEDIAL ACTION) AND TIME <br />FOR ABATEMENT (NOT MORE THAN 90 DAYS): <br />Step 1: No later than May 30, 2008, provide a P.E. certified report documenting the <br />storage capacity in Pond 12, and demonstrating whether the pond capacity is adequate to <br />treat the design storm event runoff in compliance with applicable requirements of 4.05.1, <br />4.05.2, and 4.05.6. If the certified report indicates that Pond 12 capacity is not adequate, <br />the report will address measures to be implemented to ensure that adequate sediment <br />controls are in place in the Pond 12 watershed, to ensure compliance with sedimentation <br />effluent limits of 4.05.1, 4.05.2, and 4.05.6. Such measures may include clean out of <br />Pond 12 and/or construction of Pond 12A and/or other measures as warranted. <br />Step 2: No later than June 15.2008, provide a slide remediation technical revision <br />application to amend or supplement Permit Attachment 13-12 B. The remedial plan shall <br />be prepared by a qualified geotechnical engineer, shall identify and assess the factors that <br />contributed to the failure, shall include specific remedial measures to be implemented to <br />repair the slide and effect compliance with applicable requirements of Rule 4.14, and <br />shall include a geotechnical stability analysis demonstrating that that the remedial plan <br />will result in a final slope that will comply with Rule 4.14.2(1)(b). <br />Step 3: Any remedial sediment control measures identified in the report specified in <br />Abatement Step 1, or required by the Division following review of the report, will be <br />implemented and completed no later than July 15, 2008. <br />
