ATTACHMENT TO NOV CV-2008-001 <br />NATURE OF VIOLATION: <br />Failure to implement proper stabilization, drainage control, grading, and maintenance <br />practices to ensure slope stability, prevent topsoil loss, and minimize disturbance of the <br />prevailing hydrologic balance. <br />ACT, REGULATION, OR PERMIT PROVISION(S) VIOLATED: <br />REGULATION SECTIONS <br />• 4.05.1(1), 4.05.1(3)*, 4.05.1(4)(a), 4.05.2(7)*, 4.05.2(8)*, 4.05.6(3)(a)* <br />• 4.06.4(2)(d) <br />• 4.14.2(1)(b), 4.14.2(5) <br />* Note, if operator demonstrates that settleable solids effluent limits are not applicable, <br />due to magnitude of the runoff event, the asterisked citations will not apply. <br />PERMIT SECTIONS <br />Permit Attachment 13-12B (Landslide Repair Plan and Subsequent Stability <br />Analysis) included a number of commitments and specifications to be followed in <br />association with repair (and maintenance of stability following repair) of a slope <br />failure that occurred in 2000, directly northeast of Sediment Pond 12, in the same <br />slope location that failed in 2008. <br />• Permit page 20-1 states that all bac~lled slopes in disturbed areas will be placed <br />to achieve a static factor of safety of 1.3. <br />• Permit page 21-22 states that stable postmine slopes will be designed to minimize <br />sediment runoff and gullying. <br />• Permit page 22-22 states that broadcast seeding will be carried out in areas <br />where drill seeding operations would be restricted, including riprapped drainage <br />channels and steep slopes that have been roughened by dozer or track-hoe <br />gouging (emphasis ours). <br />PORTION OF THE OPERATION TO WHICH THIS NOTICE APPLIES: <br />The lower portion of the Sediment Pond 12 watershed where a landslide has reoccurred. <br />The total topsoiled acreage affected by the slide is approximately 1.75 acres (the <br />southwestern portion of the failure zone had not been topsoiled).
