Although permitting will be under the jurisdiction of the township of <br />Windsor, the Division should require Larimer County to enforce these air <br />quality concerns since they have greater resources at their disposal. An <br />EPA assessment should be required prior to permitting. All surveys must <br />be provided to homeowners and the homeowner association. <br />3. Currently there are two other mining operations within 2000 feet of the <br />River West subdivision with the corresponding truck traffic and noise. <br />There are five subdivisions using County Road 13 south of HWY 392. <br />The only southbound accesses to these subdivisions are from the <br />intersection of Hwy 392 and CR13. County road 13 is only two lanes with <br />no shoulder. There is also a trailhead for the Poudre River Trail 'h mile <br />south of the intersection and a wildlife recreation area parking lot '/4 mile <br />south. Without any road improvements, the increase in truck traffic will <br />cause an increase in congestion and safety concerns. A Department of <br />Transportation survey of traffic flow must be performed and adequate <br />road improvements accomplished before mining operation begin. <br />Material spillage, road destruction and truck airbrake use noise must also <br />be addressed and mitigated. <br />4. The town of Windsor has no noise level limits. The Division must set a <br />residential noise level limit that must be enforced by the town of Windsor. <br />If they are unable to enforce said noise, due to equipment or manning, <br />Larimer County should be held accountable of enforcement. Noise <br />monitoring should include crusher, power production, truck braking and <br />backup horn noise. <br />5. This mining operation will have a grave effect on already diminished <br />residential home prices. Homes in River West have been on the market <br />over 120 days. The Division should limit the permit time to one year for <br />mining and reclamation to decrease the impact on real estate pricing. <br />6. The overall process of a mine permit is quite new to us. I would like to <br />have the Division give this process and the time line to us in layman's <br />terms. Any hearings with the Division or other Federal, State and local <br />entities need to be brought to our attention in a timely manner. The <br />comment period I had was only two weeks.
