Cattany <br />Division Director <br />Natural Resource Trustee <br />Listed below are the second adequacy review comments for the Red Dirt Pit 110 Application, File No. M- <br />2008-008. The Division of Reclamation, Mining and Safety (Division) is required to make an approval or <br />denial decision no later than July 1, 2008, therefore, your response to the following adequacy review <br />concerns should be submitted to the Division as soon as possible. <br />Application Form: Section 34-32.5-110(1)(a) of the Colorado Land Reclamation Act for the <br />Extraction of Construction Materials requires the application form to be filed with the office on a <br />form approved by the board. The Division does not consider the PDF version submitted as an <br />approved form. Please resubmit the Construction Materials Limited Impact (110) Operation <br />Reclamation Permit Application on an approved form. Approved forms are available at <br />www.mining. state.co.us. <br />2. The Division received comments from the Colorado Division of Wildlife. The letter is attached. <br />Please address the comments noted in the letter and make any changes in the application as necessary. <br />3. Rule 6.3.3 Exhibit C -Minim Plan Please address the following items in the Mining Plan; <br />a. Please edit the first paragraph of the Mining Plan to remain consistent with the revised <br />mining plan to mine the site at a 2:1 slope instead of the initially proposed benches. <br />4. Rule 6.3.4 Exhibit D -Reclamation Plan Please address the following items in the Reclamation Plan; <br />a. Please provide a method of weed control that shall be employed for all prohibited noxious <br />weed species, and whenever invasion of a reclaimed area by other weed species seriously <br />threatens the development of the desired vegetation. <br />The Adequacy response letter dated, April 10, 2008, states a copy of the noxious weed <br />control plan the county uses on its other mining operations is attached. The Division did not <br />receive the noxious weed control plan in the first adequacy response.
