Listed below are the second adequacy review comments for the Red Dirt Pit 110 Application, File No. M-
2008-008. The Division of Reclamation, Mining and Safety (Division) is required to make an approval or
denial decision no later than July 1, 2008, therefore, your response to the following adequacy review
concerns should be submitted to the Division as soon as possible.
Application Form: Section 34-32.5-110(1)(a) of the Colorado Land Reclamation Act for the
Extraction of Construction Materials requires the application form to be filed with the office on a
form approved by the board. The Division does not consider the PDF version submitted as an
approved form. Please resubmit the Construction Materials Limited Impact (110) Operation
Reclamation Permit Application on an approved form. Approved forms are available at
www.mining. state.co.us.
2. The Division received comments from the Colorado Division of Wildlife. The letter is attached.
Please address the comments noted in the letter and make any changes in the application as necessary.
3. Rule 6.3.3 Exhibit C -Minim Plan Please address the following items in the Mining Plan;
a. Please edit the first paragraph of the Mining Plan to remain consistent with the revised
mining plan to mine the site at a 2:1 slope instead of the initially proposed benches.
4. Rule 6.3.4 Exhibit D -Reclamation Plan Please address the following items in the Reclamation Plan;
a. Please provide a method of weed control that shall be employed for all prohibited noxious
weed species, and whenever invasion of a reclaimed area by other weed species seriously
threatens the development of the desired vegetation.
The Adequacy response letter dated, April 10, 2008, states a copy of the noxious weed
control plan the county uses on its other mining operations is attached. The Division did not
receive the noxious weed control plan in the first adequacy response. Please submit the
noxious weed control plan to the Division.
