Mid-Continent <br />completed clean-up and constructed a sediment control <br />system for the area beneath the belt line. Civil <br />penalty = $1,050. <br />e. NOV C-89-017. June 14, 1989. MLRD cited "Failure to <br />construct sediment control measures for the topsoil <br />stockpile under construction northwest of the Sutey <br />wastepile expansion." Mid-Continent provided <br />temporary sediment control during the time of <br />construction of the pile, and received a minor revision <br />(MR-17) which allowed for construction of a permanent <br />sediment control system for the topsoil pile. Civil <br />penalty = $300. <br />f. CO C-89-019. June 29, 1989. MLRD cited "Failure to <br />maintain and operate the sediment control system to <br />prevent possible additional contributions of suspended <br />solids to streamflow outside the permit area," as a <br />result of damage to the spillway pipe of the upper <br />sediment pond, which was struck by the dragline which <br />was cleaning the pond. Mid-Continent restored the pond <br />to proper function. Civil penalty paid: $2,000. <br />g. NOV C-89-033. November 27, 1989. MLRD cited "Failure <br />• to remove topsoil from areas affected by surface coal <br />mining operations." No abatement action specified. <br />Civil penalty paid: $900. <br />h. NOV C-90-001. January 4, 1990. MLRD "Failure to <br />monitor ground water in a manner approved by the <br />Division". No abatement action specified. Civil <br />penalty paid: $400. <br />i. NOV C-90-002. January 4, 1990. MLRD cited "Failure to <br />design, construct and maintain appropriate sediment <br />control measures to minimize erosion to the extent <br />possible (two gullies that had formed on the hillside <br />south of the slurry pond)." Mid-Continent received a <br />Technical Revision (TR 14) which allowed implementation <br />of additional sediment control measures. Civil penalty <br />paid: $900. <br />j. C-90-014. May 17, 1990. MLRD cited "Failure to maintain <br />culverts." Mid-Continent repaired the culverts and <br />stabilized the road outslope. Civil penalty paid: <br />$1,000. <br />k. NOV C-90-029. July 26, 1990.
