construct sediment control measures for the topsoil
stockpile under construction northwest of the Sutey
wastepile expansion." Mid-Continent provided
temporary sediment control during the time of
construction of the pile, and received a minor revision
(MR-17) which allowed for construction of a permanent
sediment control system for the topsoil pile. Civil
penalty = $300.
f. CO C-89-019. June 29, 1989. MLRD cited "Failure to
maintain and operate the sediment control system to
prevent possible additional contributions of suspended
solids to streamflow outside the permit area," as a
result of damage to the spillway pipe of the upper
sediment pond, which was struck by the dragline which
was cleaning the pond. Mid-Continent restored the pond
to proper function. Civil penalty paid: $2,000.
g. NOV C-89-033. November 27, 1989. MLRD cited "Failure
• to remove topsoil from areas affected by surface coal
mining operations." No abatement action specified.

monitor ground water in a manner approved by the

design, construct and maintain appropriate sediment
control measures to minimize erosion to the extent
possible (two gullies that had formed on the hillside
south of the slurry pond)." Mid-Continent received a
Technical Revision (TR 14) which allowed implementation
of additional sediment control measures. Civil penalty
paid: $900.
j. C-90-014. May 17, 1990. MLRD cited "Failure to maintain
culverts." Mid-Continent repaired the culverts and
stabilized the road outslope. Civil penalty paid:
