Deft. of Natural Rosourccs <br />The purpose of this letter is to request that construction of a new <br />replacement refuse conveyor from our preparation plant be approved as a <br />minor amendment to our existing plan. Plan for the new conveyor (in red) is <br />attached. <br />Our existing coal refuse pile is rapidly approaching capacity. We have, <br />for the last several years, been attempting to develop plans for a new refuse <br />• pile site and have studied several alternatives as well as various systems <br />for transporting coal refuse from the plant to the sites. The preferred site <br />became available to us only recently following our purchase of the Sutey <br />property adjacent to the plant site. Application for a refuse disposal site <br />on the Sutey property has been submitted to MLR. Installation of the plant <br />refuse conveyor is not contingent on approval of the Sutey site, nor will <br />plant refuse be disposed of on the Sutey site without prior approval of MLR. <br />Site information (see attached plan): <br />1. Conveyor will extend westerly from the preparation plant a distance <br />of S00 feet. <br />2. Conveyor and termination (transfer tower) are on or over disturbed <br />ground and totally within our present permitted area. <br />3. Our plant emergency slurry pond is located directly down-grade from <br />the belt termination point and will collect surface waters from <br />the belt termination area. <br />4. Our fresh-water pond is located adjacent to the slurry pond in a <br />northeasterly direction from the belt termination point. Because <br />of its location, this pond provides additional protection against <br />possible bypass of contaminated water from the termination point <br />area. <br />C ~ <br />J <br />__ 5 -. <br />
