III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the <br /> inspection and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Tom Kaldenbach of DRMS. Henry Barbe of <br /> Mountain Coal Company represented the operator. The ground was dry and largely snow-free <br /> at the lower elevations of the mine. Snow pack of several feet remained in higher elevations. <br /> Snow cover blocked access to Shaft 3, Sylvester Gulch Road extension, and the Deer Creek <br /> Shaft/Minnesota Reservoir area. With the operator's consent, this report was issued from the <br /> Denver office of CDMG. <br /> The longwall was reported by the operator's representative to be active in Panel 18 and <br /> development work continues in panel E-1. <br /> Hydrologic Balance <br /> The mine was not discharging mine water from outfall 017 in Sylvester Gulch. The following <br /> ponds contained water but were not discharging: SG-1 (outfall 014), MB-1 (outfall 016), MB-2R <br /> (outfall 004), and MB-3 (outfall 005), and MB-5. The pond at the North Topsoil Storage Area <br /> (on the north side of Highway 133)was dry. Embankments, inslopes, and discharge structures of <br /> the ponds appeared to be in good condition. <br /> Unlined ditches next to Sylvester Gulch Road and around shaft sites in the Gulch appeared in <br /> good repair where snow has melted. <br /> The wellheads of the E seam (03-11-1) and B seam (1-11-1) monitoring wells in the northeast <br /> corner of the permit area appeared in good condition with caps in place (see photo below). <br /> 3 <br />
