a Phase I release to no more than 60% of the applicable amount; therefore, the dollar amount eligible <br />for bond release in SL-03 is $314,909 (60% X $524,848). <br />V. PROPOSED DECISION <br />Based on the findings set forth above, the Division proposes to approve Oakridge's request for <br />Phase I bond release in the bond release area. The amount proposed for release is $314,909 of <br />reclamation liability. This proposed decision will release Oakridge from liability for backfilling, <br />grading, and drainage re-establishment in the following areas: the former North Pit mining area, the <br />North Pit Haul Road, the Permanently Reclaimed Spoil Area (PRSA), Topsoil Pile #2, the South Pit <br />Drill Pad, the Equipment Yard Area, the Carbon Junction Channel, and ancillary adjacent areas. <br />Reclamation liability remains for backfilling, grading, and drainage re-establishment for the <br />following areas: topsoil stockpiles 4, 7, and 8; the two sediment control ponds (1 and 2); various <br />ditches; and various boreholes. Reclamation liability also remains for removal of equipment stored <br />in the Equipment Yard. Reclamation liability remains for topsoiling and revegetation on all <br />disturbed areas. <br />The Division currently holds a reclamation bond from Oakridge in the amount of $695,436 for the <br />entire Carbon Junction Mine. Current reclamation liability is estimated to be $718,110, based on the <br />"Calculation of SL-03 Bond Release Amount", dated Apri17, 2008, in the SL-03 file. The amount <br />of bond applicable to the bond release area is $524,848. The Division proposes to release $314,909 <br />of the reclamation liability, leaving liability of $403,201. This amount will be retained for the <br />remainder of all areas under permit C-92-080 at the Carbon Junction Mine, and is sufficient for a <br />third party to cover the cost of reestablishing revegetation on the lands that have not yet received <br />Phase II bond release. The retained amount is approximately $10,721 per acre for lands that remain <br />to be backfilied, regraded, topsoiled, and seeded. <br />Any person with a valid legal interest which might be adversely affected by this proposed decision <br />may request a formal public hearing before the Mined Land Reclamation Board in accordance with <br />Section 3.03.2(6). Public notice of this proposed decision will be published once weekly for two <br />weeks in the Durango Herald for two weeks as soon as possible. Requests for public hearing must <br />be submitted to the Division in writing within thirty days of the first publication in the Durango <br />Herald. If no hearing is requested within that thirty days, the Division's proposed decision will <br />become final. <br />7 <br />
