The permanent fencing materials involved in this agreement shall have a normal life of <br />thirty (30) years. The Landowner agrees not to submit a damage claim during the <br />agreed period for loss of property or crops protected by this fence. <br />6. The Landowner hereby states and certifies that the permanent fencing has within the <br />Landowner's property boundary lines. In consideration of the covenants and <br />agreements contained herein, the Landowner hereby agrees that sheltie will indemnify <br />and hold the Division harmless from all loss or damage, including costs, interest, and <br />attorney's fees which the Division may sustain as a result of any action, suit, or <br />proceeding brought against the Division for trespass, or other claims which may be <br />asserted by parties other than the undersigned. <br />7. The landowner hereby states and certifies that all prevention materials previously <br />provided by the Division have been used and maintained for damage control only, <br />hunting for the species causing damage is not restricted on any lands owned or <br />controlled; a fee in excess of $100 is not charged for access on or through lands <br />owned or controlled; access to, or passage across lands owned or controlled is not <br />restricted for purposes of hunting said species; and the hunting rights for said species <br />are not leased on such lands where the fence is to be located. <br />8.
