U.S. Hwy 40, Craig, CO 81625 (hereinafter referred to as the "Grantees"). <br />The parties agree as follows: J_ <br />t <br />For TEN DOLLARS ($10.00) and other good and valuable consideration, the receipt and; <br />sufficiency of which are hereby acknowledged, the Grantors have this date bargained, <br />conveyed, delivered, transferred, and sold, and by these presents;: do bargain, convey, <br />deliver, transfer and sell unto the Grantees, their successors and assigns, and warrant the <br />title to the same (subject to easements and encumbrances or record); two perpetual; non- <br />exclusive easements (hereinafter referred to as the "Primary Easement" and "Ser ndary <br />Easement"), for access to and egress from and for the benefit of and appurtenant to the <br />land South of the Yampa River described in the Warranty Deed, dated,March 21, 1963, <br />from William O. Chambers and Frances M. Chambers to George A Duzik:and Evelyn' <br />Duzik, recorded at Book 311, Page 4, Reception 161038 of the tecords of the Moffat <br />County, Colorado, Clerk and Recorder (hereinafter referred to as the "Dominant Estate").' <br />r Over and:across the land described in the Warranty Deed dated Febru X` <br />ary 14, 1979 from <br />John F Ashbaugh and Donna M. Ashbaugh to James H. Ross and Kathleen, H. Ross, <br />recorded,at:Book 451, Page 751 and 752, Reception 244643 and the Correction Warranty <br />Deed :dated; February 23, 1979, from John F. Ashbaugh and Donna M. Ashbaugh -to rt' <br />James H. Ross and Kathleen H. Ross, recorded at Book 452, Page 20 and 21 , Reception " <br />.244801 of the records of the Moffat County, Colorado, Clerk and Recorder, (hereinafter <br />referred to as the "Servient Estate"). <br />The two easements granted herein shall be used for agricultural and ranching purposes, <br />3 ? '4 <br />including hauling" of livestock and crops, moving of farm machinery and equipment, <br />caring and tending livestock and growing crops, the care and maintenance of the two ` <br />easements, and all other uses necessarily incident thereto. <br />The Primary Easement being described as commencing at the main gate on the Southern <br />Boundary of the Servient Estate and following what is commonly known as the Deep Out Ditch Road, to the existing gate at the Southern boundary line of She Dominant Estate. <br />The location: and width of the Primary Easement shall be the same as ,the Deep Cut Ditch <br />Road as it presently exists. <br />The Secondary Easement shall also commence at the main gate on the Southern"Boundaryof the Servient Estate and follow the Southern and Eastern boundary tine of the Servient _ <br />r Estate to the existing gate on the Southern boundary of the Dominant Estate.
