EXHIBIT A - Legal Description <br />(1) The affected area consists of a +/- 62 acre parcel located within the NEA of <br />Section 3, T6N, R90W. The land owner/applicant will be the same. 4B Land & <br />Livestock LLC is wholly owned by Scott R. and Sheila M. Brennise, the <br />landowner of the 62 acre parcel as described in the attached January 2008 <br />Warranty Deed and Exhibit A. The 80.5 acre tract to the south (Moffat County <br />Map Parcel I.D. 4212) is also owned by Scott R. and Sheila M. Brennise. Access <br />to the 62 acre parcel will be via a road constructed along an easement crossing the <br />80.5 acre parcel as described. <br />(2) The proposed site lies in the NEA of Section 3, T6N, R90W, 60' Colorado P.M. in <br />Moffat County, Colorado, approximately 4.50 miles East Southeast of Craig, <br />Colorado. As shown on the location maps, the site is approximately 4 miles east <br />on State Hwy 394 then and <1/2 mile north of the State Hwy 394 R.O.W. A <br />permitted access will allow ingress and egress to the location via a perpetual <br />easement granted to the 62 acre parcel for access to Hwy 394. A private road will <br />be constructed along the easement. Gates will be located at the Hwy 394 access <br />point and at the actual 62 acre parcel entrance located at the SE corner of the <br />NE/4 of Section 3 (approximately 2350 feet north along the fence line from Hwy <br />394). The road can/will be used for other farm/ranch operations by the owner as <br />well as for the 62 acre parcel access easement and the associated permitted <br />mining/processing/hauling activities. The road will be maintained by the <br />landowner as part of the applicants overall farm/ranch activities and it will not be <br />included as part of the total 112 permit area. The road will be permanent and will <br />remain after reclamation as the legal access for the parcel. The road will be <br />repaired and maintained as necessary. The road will have a gravel surface. Road <br />gravel for this road may or may not be produced at the site. <br />(3) All areas of the proposed site that will be disturbed are currently pasture. There <br />are no water rights attached to the 62 acre parcel or ownership in any Deep Cut <br />Ditch water. There is no current irrigation in the pasture areas. All disturbed <br />areas will be reclaimed to developed water resource (2 pond areas) for <br />evaporation only. The applicant would be required to obtain any water to be <br />used for other purposes such as irrigation. There are no wet-lands, or other water <br />resources that will be affected by the site activities. There will be no disturbance <br />within 100 feet of the Yampa River, Deep Cut Ditch and Brennise water well. If <br />the well is affected, the landowner/applicant will have to deepen, repair and/or <br />relocate the well as per the Exhibit S Damage Agreement.
