~' Mark McLean, P.E. <br />April 16, 2008 <br />Page 2 <br />approximately 1,600 feet from the Arkansas River, and you have provided a monthly <br />schedule of lagged depletions to the river, together with a schedule of replacement <br />requirements that include a transit loss totaling 11.5 acre-feet during the plan year (see <br />Table 4). <br />REPLACEMENT <br />The proposed source of replacement water for this substitute water supply plan is <br />11.5 acre-feet of reusable municipal return flows from the Cherokee Metropolitan District <br />(Cherokee) wastewater treatment plant in Colorado Springs or other fully consumable <br />water provided by agreement between Beltramo and the Arkansas Groundwater Users <br />Association (AGUA). A transit loss of 17.0 percent (10 percent on Sand Creek and 7 <br />percent on Fountain Creek) has been calculated into the total amount of water <br />purchased, although the actual transit loss will be determined using the Fountain Creek <br />Transit Loss Model. We understand that Cherokee may be moving their wastewater <br />treatment facility to an area located in the Upper Black Squirrel Creek Designated <br />Ground Water Basin. At the same time, the reusable effluent return flow from the <br />facility will no longer accrue to Sand Creek/Fountain Creek, and will no longer be <br />available as a replacement source; however, the effluent will be available at its current <br />location for the duration of this plan.. <br />You have calculated that, based upon the lagging effects, 5.37 acre-feet of <br />depletions will occur after the expiration of this plan (March 31, 2009). Replacement <br />water for these post plan depletions will be secured through an acceptable means of <br />financial security to be maintained by AGUA. <br />The State and Division Engineers have reviewed the plan and the adequacy of <br />each source of water provided for use as augmentation water, including, where <br />necessary, the historical consumptive use of each water right, and return flows from <br />diversion of waters imported into the Arkansas River Basin or other fully consumable <br />waters proposed for use as augmentation water. In accordance with Section 25-8- <br />202(7), C.R.S. and Senate Bill 89-181 Rules and Regulations adopted on February 4, <br />1992, the State Engineer has determined that subject to the terms and conditions <br />below, the replacement supply is of a quality to meet the requirements of use to senior <br />appropriators. <br />CONDITIONS OF APPROVAL <br />This substitute water supply plan is hereby approved pursuant to Section 37-90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This plan is approved until March 31, 2009. Forward to the Division Engineer within <br />two weeks of this approval, a contact name and phone number at the gravel pit site. <br />2. The surface area of groundwater exposed within the pit shall not exceed one acre. <br />Documentation of water surface area may be required by the Division Engineer in the <br />
